Mr. Skoulis questioned what was behind the sign on <br />the roof, and further pointed out that the regulations pertaini.ng to pole <br />signs are being changed and asked if the developer would be willing to change <br />the pole sign. Mr. Vannelli responded that the grill vent is behind the sign <br />on the roof, and they would be willing to change the pole sign. Mr. Orlowski <br />questioned if they did not need a variance for the size of the lot, and was <br />advised that since this is a platted lot, they did not. City Engineer <br />Deichmann advised that the lot is zoned General Retail entirely. In response <br />to the members questions, Mr. Vannelli stated that they probably would be open <br />from 11:00 a.m. to 11:00 p.m. initially, but this could be changed if business <br />required it. Assistant La.w Director Dubelko advised that there is an ordinance <br />regulating hours of operation of a drive through facility depending on the <br />proximity of the restaurant to the residential area, and advised them to check <br />this with the Building Department. The members would like the bright orange <br />color of the building changed to something more subdued, pointing out several <br />businesses who did modify colors. Mr. Varmelli stated that since these are <br />stick built units the colors could be changed and he would talk to the owners <br />about it. Mr. Orlowski would like a more substantial dumpster enclosure. Mr. <br />Vannelli stated that they usually installed board on board fences (plans <br />showed chain link with slats). He presented photographs of existing <br />facilities. Mr. Thomas pointed out that there were lights washing the roof and <br />the sign on the roof was illuminated, so the city would consider that whole <br />area as a sign. Mr. Vannelli stated that they could delete the lights. It was <br />noted that the driveway only has one curb cut divided by an island. Mr. <br />Skoulis questioned where the board on board fence would be and what was <br />planned for the rear property. Mre Vannelli advised that the fence would only <br />be around the dumpster, that about fifty foot in the rear would be seeded and <br />the rest would remain natural. There is also an existing fence along the U <br />Store It property line. It was clarified that the property only dropped about <br />4 foot. Mr. Gorris is concerned that lights from vehicles would shine in the <br />adjacent residential windows. Mr. Thomas would like the Architectural Board to <br />review the buffering. Mr. Gorris thought perhaps a mound would be helpful. <br />Mrs. Sowl, a neighbor, questioned the days of the week and the hours this <br />facility would be open. She was advised it would be open 6 da.ys a week, and <br />the hours would depend on whatever the City would allow. Mr. Vannelli stated <br />that they normally did not open on Sundays, but Mr. Thomas cautioned her to <br />asstune that if business is good they will operate on Sundays, and that the <br />developers had stated that if it was warranted they might open for breakfast. <br />Chief Building Inspector Sanker believe that hours are restricted if the <br />business is less than 200 feet from a residence, but this will have to be <br />verified, along with where the distance is actually measure from, the property <br />line or the house. Mrs. Sowl was advised that the building would be 50 feet <br />from Lorain Road and the building is about 55 feet deep. She stated that this <br />is about where her property ends and she was concerned about this type of <br />operation because of noise, debris, etc. If there is no way that this can be <br />stopped, the residents would like a 6 foot high fence constructed going north <br />and south from where the property begins on Lorain along the property line to <br />the end and then across the rear property line to the west where the U Store <br />It fence is located. Mrs. Pietroroia, another neighbor, stated that there is <br />already a problem with young people cutting through the vacant lot and their <br />properties now and they need something to stop that. Mr. Thomas pointed out <br />that they should have a buffer to lessen the impact this business will have on <br />their properties,to have some type of fence or mound to keep headlights from <br />4
