He advised that this is a new plat but there was no <br />change to the plat itself, and only a clause was added regarding acceptance of <br />one of the property owners. Variances have been granted for the area of the <br />non-conforming lot and the frontage of both lots. Mr. Skoulis questioned if <br />legally the Commission could approve this assembly of properties which are not <br />owned by the same person. Assistant Law Director stated that they could. The <br />members had no further questions. R. Bowen moved to approve the lot split lmow <br />as the Mikolay Lot Split and Assembly Plat to split permanent parcel nos <br />232-6-10 and 25 located on the north side of Lorain Road west of West Park <br />Drive, into two (2) sublots, and to join sublot number one with parcels 232-6-9 <br />and 232-6-13, seconded by A. Skoulis, and tmanimously approved. <br />V. COMMCTNICATIONS : <br />Chairman Gorris advised that a letter had been received from Mayor Boyle <br />regarding Ordinance #91-132 for the rezoning of lots on Columbia Road and <br />Country Club Boulevard. The Mayor explained that there had been a typographical <br />error in the deed restrictions regarding the height of the building. This <br />restriction should have been for 4 stories/48 feet rather than 7 stories. Mr. <br />Skoulis, who had been a member of the negotiating team, advised that everyone <br />thought that the height restriction would be 4 stories since that was what was <br />shown on the renderings along with the landscaping and the setbacks. At their <br />last meeting he had questioned if something could be put in the record that the <br />residents in that area had accepted and approved a specific landscaping and <br />setback plan in order to require the developer to adhere to that plan when the <br />actual development plans are presented. Assistant Law Director Dubelko advised <br />that the Council could put this into their approval and suggested that he <br />contact the Chairperson of the Building Zoning and Development Committee about <br />it. He further clarified that basically the Planning Commission had approved <br />this with the deed restrictions and as long as it was noted that there was an <br />error in the deed restriction which is going to be rectified, no further action <br />by the Comn.ission should be necessary. Chairman Gorris requested that the <br />Mayor's letter be attached to minutes of tonight's meeting so that it is lnown <br />that the Commission has read it, and they understand and concur with it. Mr. <br />Morgan clarified that it would not be necessary to review Ord. 90-132 again. <br />VI. COMNITTEE REPORTS: <br />No items. <br />VII. NEW BUSINESS : <br />No items <br />OLD BUSINESS: <br />The members discussed the master plan in committee earlier this evening. The <br />contract with County Planning Commission has been approved and signed by the <br />Mayor; and a copy will be sent to each member. Mr. Gorris further advised that <br />beginning in January, the second monthly Planning Commission will be limited to <br />meeting with County Planning and will commence at 7:00 p.m. <br />Building Coirunissioner Conway presented plans for a minor change to the Clark <br />Oil Canopy which was approved by the Commission previously. Members had no <br />objection. <br />2
