5. Dennis J. Walsh, 5635 McKenzie Road. <br />Request for variance (1123.12). Request 114 square foot variance for garage <br />area. Violation of Ord. 87-93, Section 1135.02-(c). <br />Chairman Gomersall called all interested parties before the Board. The oath was <br />administered to Mr. Walsh who explained he needed a larger garage and pointed <br />out that he had a large lot. The members agreed that this garage was consistent <br />with others in the neighborhood, E. Gallagher moved to grant the request for a <br />114 square foot variance for garage area for Dennis J. Walsh, 5635 NIcKenzie <br />Road, seconded by T. Restifo, and unanimously approved. Variance granted. <br />6. Frank Pascuzzi, 4533 Westview Drive. <br />Request for variance (1123.12). Request 40 foot set back variance for gazebo <br />on corner lot (adjacent property has a 50 foot set back). Violation of Ord. <br />87-93, Section 1135.02D-5. <br />Chairman Gomersall called all interested parties before the Board. The oath was <br />administered to J. Held, contractor, who explained,that because this is a <br />corner lot, the set back had to be 50 feet back. Mr. Conway clarified that <br />since this is a corner lot, and the adjacent property has a 50 foot setback, <br />this building should be setback 50 feet to conform to that setback. The gazebo <br />would be 22 feet from the neighbors property. B. Grace moved to approve the <br />request for a 40 foot setback variance for a gazebo on corner lot (adjacent <br />property has a 50 foot setback) for Frank Pascuzzi, 4533 Westview Drive, <br />seconded by R. Gomersall, and unanimously approved. Variance granted. <br />7. Thomas E. Porubsky, 28109 Angela Drive. <br />Request for variance (1123.12). Request 10 foot rear yard variance to <br />construct room addition. Violation of Ord. 87-93, Section 1135.08(a). <br />Chairman Gomersall called all interested parties before the Board. The oath was <br />administered to Mr. Porubsky who explained that they would like to add a fourth <br />bedroom on the back of the house. Members had no problem with the request. R. <br />Gomersall moved to grant the request for a 10 foot rear yard variance to <br />construct room addition to Thomas E. Porubsky at 28109 Angela Drive, seconded <br />by J. Maloney, and unanimously approved. Variance granted. <br />8. Russel Corbin, 6230 Barton Road. <br />Request for variance (1123.12). Request 450 square foot variance for garage <br />area to construct detached garage. (Existing attached garage will be <br />converted into a family room. Violation of Ord. 87-93, Section 1135.02-(c)1. <br />Chairman Gomersall called all interested parties before the Board. The oath was <br />administered to Mra Corbin who explained he needed the garage for his five <br />classic cars, a recreational vehicle, and a work shop. The existing attached <br />garage would be changed to a family room. He maintained that he does not sell <br />the cars, merely collects and restores them. He does not plan on any commercial <br />use of the property, but he needs a 10 foot high door for his R.V. Mr. Grace <br />stated that if the R.V. can be stored inside it would not be seen from the <br />street. Mr. Maloney questioned if a retaining wall would have to be installed <br />on the south side. Mr. Corbin is not sure since there are railroad ties which <br />seem to be holding the ground back. Mr. Gomersall is concerned since this <br />could become a commercial enterprise. Building Commissioner Conway stated that <br />he could order a business discontinued. E. Gallagher moved to grant the request <br />3
