<br />Chairman Gomersall called all interested parties before the Board. The oath was
<br />administered to Mr. Uronis, contractor, and neighbors, M. Copple, R. Finch, Mr.
<br />and Mrs. Willitis, Mr. Tasse, Mrs. Bolmert, Mr. Hock, Mrs. Rugala, Mr. and Mrs.
<br />Joines, Mr. Slyder, Mr. Urban, Mrs. L. Bunte, Mr. and Mrs. Lepois, Mr.
<br />Annunziata, Mrs. Zweigart, M. Oberer, B. Himes, P. Rugala, Mr. and Mrs. Bugay,
<br />D. Slezak, P. Trimarchi, L. Filbin, and M. Bixler. Building Commissioner Conway
<br />clarified that the variance stated was ba.sed on this structure being 7 foot
<br />frorn the property line, in the open position the dome would be within 2 foot of
<br />the property so an 8 foot rear yard variance would be neededo Mr. Himes, the
<br />spokesman for the neighbors, stated that because of the topography of this area
<br />several adjacent homes look down on this property. He stated that there is a
<br />fence, pool and satellite dish on this lot which is not very large and it is
<br />quite tmsightly. He maintains that no one actually lives in the house, that a
<br />young adult is dropped off there occasionally and spends the day. There is no
<br />landscaping, only grass and weeds. A neighbor questioned if a height variance
<br />was required. Mr. Conway advised that when the new codes come into effect there
<br />will be some height restrictions. He further stated that when the satellite
<br />dish was erected, the adjacent property owners were notified, but most of the
<br />land was still owned by the developer. Neighbors do not believe that the
<br />satellite dish conforms to the code. Mr. Conway will have that checked. A
<br />neighbor questioned why a fence was allowed on the easement. It was clarified
<br />that the owners of this property would not grant an easement, so the sewer
<br />wotild have to be snaked across someone else's property. This has nothing to do
<br />with the request. The neighbors objected because only one person in the back
<br />was notified. They were advised that this ordinance has been changed. J.
<br />Maloney moved to approve the request of Lois Furin, 5572 Quail Run, for a 1
<br />foot side yard variance and 8 foot rear yard variance to construct dome over
<br />swimming pool, and also a variance for structures which exceed the 20% maX;m?m,
<br />coverage allowed for required rear yard area, seconded by E. Gallagher. Roll
<br />call on motion: Maloney, Gallagher, Restifo, and Gomersall, no. Motion failed
<br />to pass. Variances denied.
