j. ,? .
detached garage with the condition that fire-walls be required on the on the
side wall where the variance is granted and on the wall closest to the
dwelling, seconded by J. Maloney, and tmanimously approved. Vaxiances granted.
15. Lois Furin, 5572 Quail Run.
Request for variance (1123.12). Request 1 foot, 6 inch side yard vaxiance and
3 foot rear yard variance to construct dome over swimming pool. Violation of
Ord. 87-93, Section 1135.02(1). Also request variance for structures which
exceed the 20% max;rmum coverage allowed for required rear yard area. Violation
of Ord. 87-93, Section 1135.02(d)2.
Chairman Gomersall called all interested parties before the Board. The oath was
administered to Mr. Uronis, contractor, and neighbors, M. Copple, R. Finch, Mr.
and Mrs. Willitis, Mr. Tasse, Mrs. Bolmert, Mr. Hock, Mrs. Rugala, Mr. and Mrs.
Joines, Mr. Slyder, Mr. Urban, Mrs. L. Bunte, Mr. and Mrs. Lepois, Mr.
Annunziata, Mrs. Zweigart, M. Oberer, B. Himes, P. Rugala, Mr. and Mrs. Bugay,
D. Slezak, P. Trimarchi, L. Filbin, and M. Bixler. Building Commissioner Conway
clarified that the variance stated was ba.sed on this structure being 7 foot
frorn the property line, in the open position the dome would be within 2 foot of
the property so an 8 foot rear yard variance would be neededo Mr. Himes, the
spokesman for the neighbors, stated that because of the topography of this area
several adjacent homes look down on this property. He stated that there is a
fence, pool and satellite dish on this lot which is not very large and it is
quite tmsightly. He maintains that no one actually lives in the house, that a
young adult is dropped off there occasionally and spends the day. There is no
landscaping, only grass and weeds. A neighbor questioned if a height variance
was required. Mr. Conway advised that when the new codes come into effect there
will be some height restrictions. He further stated that when the satellite
dish was erected, the adjacent property owners were notified, but most of the
land was still owned by the developer. Neighbors do not believe that the
satellite dish conforms to the code. Mr. Conway will have that checked. A
neighbor questioned why a fence was allowed on the easement. It was clarified
that the owners of this property would not grant an easement, so the sewer
wotild have to be snaked across someone else's property. This has nothing to do
with the request. The neighbors objected because only one person in the back
was notified. They were advised that this ordinance has been changed. J.
Maloney moved to approve the request of Lois Furin, 5572 Quail Run, for a 1
foot side yard variance and 8 foot rear yard variance to construct dome over
swimming pool, and also a variance for structures which exceed the 20% maX;m?m,
coverage allowed for required rear yard area, seconded by E. Gallagher. Roll
call on motion: Maloney, Gallagher, Restifo, and Gomersall, no. Motion failed
to pass. Variances denied.
16. Michael Galati, 27539 Lorain Road. Request special permit to add to non
conforming building. Special permission required Ord. 87-93, Section
1165.02(b)l. Previous special permits granted April 10, 1986 and February 7,
1990 have expirede
Approved by Planning Commission May 28, 1991.
Chairman Gomersall called all interested parties before the Board. The oath
was administered to Mr. Galati who explained that this proposal is slightiy
different than the previous one in that the addition would be one bay larger,
6
