• r <br />Chairman Gomersall called all interested parties before the Board. The oath was <br />administered to Mr. and Mrs. Koenig, and Mr. Wagner, contractor. The members <br />stated no objection to the request. J. Maloney moved to grant the request for <br />Mr. and Mrs. Bob Koenig, 29726 Vita Lane, for a 22 foot rear yard variance to <br />construct a patio enclosure and also a special permit to add to a non- <br />conforming dwelling (rear yard), seconded by E. Gallagher, and unanimously <br />approved. Variance and special permit granted. <br />13. Mr. and Mrs. Ressler, 4376 Dover Center Rd. <br />Request for variance (1123.12). Request 46 foot rear yard variance to <br />construct addition (location of existing carport). Violation of Ord. 87-93, <br />Section 1135.08(a). Also request special permit to add to non-conforming <br />dwelling. Special permission required by Ord. 87-93, Section 1165.02. <br />Variance for carport granted June 8, 1988. <br />Chairman Gomersall called a11 interested parties before the Board. The oath was <br />administered to Mr. Potts, contractor, Mr. and Mrs. Ressler, and G. Schmidt, <br />the neighbor to the rear. A variance was previously granted for a carport in <br />this location. A detached garage will be constructed, but does not require a <br />variance. Mr. Potts stated that there was a concern when the previous variance <br />was granted that the carport would be used for trucks. Mr. Gomersall pointed <br />out that originally they received a variance for a carport and now they are <br />requesting something solid; each is a major change. Mr. Schmidt advised that he <br />had not owned his home when they got the previous variance, but he had no <br />problem with it because it was open. With this proposal he is concerned that <br />the trees beside his home will be damaged. He is objecting because this <br />structure will be 4 feet from his property line. Mre Ressler stated that they <br />are trying to enlarge the kitchen and entrance way. It was clarified that the 4 - <br />foot variance was measured from the overhang of the building, the foundation <br />would be 6 feet from the line. Mr. Schmidt stated that there were areas where <br />they could add to the house without coming so close to his linea The members <br />agreed it was too close. Mr. Gomersall suggested that they withdraw in order to <br />come back with a different proposal. Mrs. Ressler explained that they had a <br />purchase agreement for the house with the contingency that they would get the. <br />variance. E. Gallagher moved to grant the request for Mr. and Mrs. Ressler, <br />4376 Dover Center Road, for a 46 rear yard variance to construct an addition <br />(location of existing carport) and a special permit to add to a non- conforming <br />dwelling, seconded by T. Restifo. Roll call on motion: Gallagher, Restifo, <br />Maloney, and Gomersall, no. Motion failed to pass. Variance denied. 14. Michael & Patricia Chabot, 24133 Mastick Road . <br /> <br />Request for variance (1123.12). Request 4 foot side setback variance to <br />construct detached garage. Also request 14 foot variance for distance between <br />house and detached garage. Violations of Ord. 87-93, Section 1135.02(c)-1. <br />Chairman Gomersall called all interested parties before the Board. The oath <br />was administered to Mr. Chabot, and Mr. Wallace, contractor. They explained <br />that they would like to tear down the existing one car garage which is 1 foot <br />off the property line, and construct a 2 ca.r garage. The wall closest to the <br />house will be fire-walled. Building Commissioner Conway would like the wall <br />closest to the property line fire-walled as well. The members had no problem <br />with the request. T. Restifo moved to grant Michael and Patricia Chabot at <br />24133 Mastic Road; the request for a 4 foot side setback variance to construct <br />a detached garage and also a 14 foot variance for distance between house and <br />5
