. ?_ ' . <br />CITY OF NORTH OLMSTED <br />BOARD OF ZONING APPEALS <br />MINUTES - OCTOBER 2, 1991 <br />Chairman Gomersall called the meeting to order at 7:30 p.m. <br />Present: B. Grace, J. Maloney, T. Restifo, and R. Gomersall. <br />Absent: E. Gallagher. <br />Also Present: Law Director Gareau, Building Commissioner Conway and <br />Clerk of Commissions Oring. <br />The review of the minutes of September 4, 1991 will be deferred Lmtil <br />the next meeting. <br />Chairman Gomersall advised the applicants that only 4 members were present at <br />this meeting and since it will take 3 affirmative votes to approve a request, if <br />anyone preferred to withdraw tmtil the next meeting, he should do so at this <br />time. 1. M. Shiels, 24135 Maria Lane. <br /> <br />Request for variance (1123.12). Request 18 foot rear yard variance to <br />construct an addition. Violation of Ord. 90-125, Section 1135.08(a). Also <br />request 7 foot 6 inch variance for distance between addition and detached <br />garage. Violation of Ord. 90-125, Section 1135.02(c)2. <br />Chairman Gomersall ca.lled all interested parties before the Board. The oath was <br />administered to Mr. Shiels, Mrs. Demetzky and Mrs. Clesh, neighbors, and Mrs. <br />Toth, the daughter of Mrs. Tanka, a neighbor, and a second daughter who was not <br />identified. Mr. Shiels explained that he wanted the addition for extra room for <br />his mother. Mrs. Toth stated that if this addition was constructed all her mother <br />would see was a solid wall, and pointed out that there was a large porch there <br />also. Mr. Shiels responded that the porch was to be removed. She is still <br />concerned because the addition and the garage will practically form a solid wall. <br />Mr. Shiels clarified that the room wi.ll be constructed 3 feet deeper than the <br />existing porch. The daughter also stated that he had very little yard, since the <br />drive went around the ga.rage. Mr. Gomersall stated that there was 21 feet between <br />the addition and Mrs. Tanka's house. Mr. Grace asked if they would consider <br />adding to the side, but this would put the addition closer to the neighbor. It <br />was explained that there would only be 7.5 feet between the addition and the <br />garage. Mrs. Demetzky stated that, when she talked with Mrs. Tanka, she did not <br />seem to understand where the addition was to be. Mrs. Clesh advised that she <br />originally thought that an addition was being built on to the garage for his <br />construction business, but has no objection to this request. J. Maloney moved to <br />approve for M. Shiels, 24135 Maria Lane, the request for an 18 foot rear yard <br />variance to construct an addition and also the request for a 7 foot 6 inch <br />variance for distance between addition and detached garage with the condition <br />that a fire wall be built on the corner of the garage closest to the house, <br />seconded by B. Grace, and Lmanimously approved. It was clarified that aIl the <br />members had seen the property. Variances granted. <br />2. Daniel and Kell_y Gorey, 23115 Surunerland Ave. <br />Request for variance (1123.12). Request 15 foot front setback variance to <br />construct an addition.. Also request a 4 foot total side yard variance. <br />Violations of Ord. 90-125, Sections 1135.05 and 1135.07(a). Also request <br />special permit to add to non-conforming dwelling (side setback). Special <br />permission required Ord. 90-125, Section 1164.02. <br />Chairman Gomersall called all interested parties before the Board. The oath was <br />administered to Mr. and Mrs. Gorey.
