Grace moved to grant the request of Daniel and Kelly Gorey, 23115 <br />Simunerland Avenue, for a 15 foot front setback variance, a 4 foot total side yard <br />variance and a special permit to add to a non-conforming dwelling (side setback), <br />seconded by T. Restifo, and imani.mously approved. Variances and special permit <br />granted. <br />3. Robert W. Nagy, 24341 Gessner Road. <br />Request for variance (1123.12).. Request' 3 foot variance for distance between <br />proposed addition and detached garage. Violation of Ord. 90-125, Section <br />1135.02(c) . <br />Chairman Gomersall called all interested parties before the Board. The oath was <br />administered to Mr. Nagy who advised that he will be buildirxg a new garage within <br />2 years and would move it back. Mr. Gomersall advised that a fire wall would ha.ve <br />to be installed. Mr. Conway clarified that 3 foot sections of fire wall must be <br />installed on both the front and side of the garage. T. Restifo moved to grant the <br />request for Robert W. Nagy at 24341 Gessner Road, a 3 foot variance between the <br />proposed addition and detached garage, seconded by J.. Ma.loney, and unanimously <br />approved. Mr. Restifo moved to amend his motion to include the condition that the <br />3 foot sections of fire wall be installed, seconded by J. Maloney, and <br />unanimously approved. Variance granted. Builcling Commissioner Conway clarified <br />that the fire wall is not actually a code requirement, so when a variance is <br />requested this has been included in the_ motion. <br />4. Auto Accents, 24052 Lorain Road. Request for variance (1123.12). Request 27.75 sq. ft. variance for total sign <br />area. Also.request variance to add to existing pole sign. Violation of Ord. <br />90-125 Section 1163.11(c) and 1163.22(a). <br />Cha.irman Gomersall ca.lled all interested parties before the Board. The oath was <br />administered to Mr. Yousef, the owner, who advised that the previous temporary <br />sign had brought in business during the three months it was up, but since it has <br />been removed have lost about $4,000.00 a month. He clarified that instead of the <br />temporary banner that was previously approved, he would like to install a <br />permanent aluminun sign. He presented pictures proving that his sign is the only <br />one.in the plaza which is not visible from Lorain Road. He stated that they do <br />advertise, but customers still claim that they cannot find the store even though <br />they do have space on the pole sign. He stated that if the store does not get <br />more visibility it will go out of business. . He further advised that when he <br />rented the.tm.it he was not told that the center would be lower than Lorain Road. <br />Building Comissioner Conway advised that a condition of the variance for the <br />pole sign was that each tenant would only be permitted one space. Mr. Yousef <br />stated that, i.f he gets this sign, he would be willing to put a public service <br />message in his insert on the sign. The members did not lielieve that he should <br />give up that space asid agreed that he had a hardship. J. Maloney moved to grant <br />the request of Auto Accents, 24052 Lorain Road, for a 27.75 square foot variance <br />for total sign area and a variance to add to the existing pole sign, seconded by <br />B. Grace. Mr. Conway suggested that perhaps this variance should be re-reviewed <br />in a year; and he also need a letter from the owner of the center agreeing to the <br />sign. The motion was amended to include that the variance is to be limited for a <br />period of one year and with a condition tha.t the owner must agree to to the sign. <br />The motion was approved iman;mously Variance granted. <br />5. Jeff Uniatowski, 24479 Gessner Road. <br />Request for variance (1123.12). Request 1 foot 6 inch variance to install <br />2
