The oath was <br />administered to Mr. and Mrs. Uniatowski who explained that the 4 foot high picket <br />fence on the side street wouid be 50% open. They will be installing a solid fence <br />to match the neighbors fence on the balance of the lot. The members ha.d no <br />problem with the request. B. Grace moved to grant the request for Jeff <br />Uniatowski, 24479 Gessner Road, for a 1 foot, 6 inch variance to install fence in <br />corner lot setback which will be 50% open, seconded by T. Restifo, and <br />unanimously approved. Variance granted. <br />6e Don Rogers, 30856 Windy Hollow <br />Request for variance (1123.12). Request 6 foot rear yard variance to <br />construct patio enclosure. Violation of Ord. 90-125, Section 1135.08-(a). <br />Chairman Gomersall ca,lled all interested parties before the Board. The contractor <br />representing Mr. Rogers had earlier advised that he might-be late and had not <br />arrived. The members stated it was really not necessary tha.t he be present, and <br />Mr. Rogers stated tha.t he preferred to proceed with the hearing. The oath was <br />administered to Mr. and Mrs. Rogers. The members had no problem with the request. <br />T. Restifo moved to grant the Don Rogers' family at 30856 Windy Hollow their <br />request for a 6 foot rear yard variance to construct a patio enclosure, seconded <br />by J. Maloney, and unanimously approved. Variance granted. <br />7. Brooklor Center (R. L. Stark Ent.), 25905 to 26041 Lorain Road. <br />Request for variance (1123.12). Request 2 foot variance for width of service <br />driveway. Violation of Ord. 90-125, Section 1161.10. <br />Chairman Gomersall called all interested parties before the Board. The oath was <br />administered to Mr. Bedar, who represented the developero He explained that when <br />the plans were drawn, the architect did not account for the fact that the <br />property line and the building are not parallel, so that at one point the drive <br />is 18 feet, but at the other it is about 16.2 feet wide and at that point there <br />is a telephone pole and a fire hydrant. So wha,t they thought would be 18 feet is <br />actually 16 feet. This drive is not used for tractor trailer deliveries. The <br />members had no problem with the requesto Mr. Grace suggested protecting the <br />hydrant with a steel pole. J. Maloney moved to grant to the Brooklor Center 25905 <br />to 26041 Lorain Road a 2 foot variance for width of service driveway, seconded by <br />B. Grace, and unanimously approved. Variance granted. <br />8. James Miller, property located between 5938 and 5918 Porter Road. <br />Request for variance (1123.12). Request 4 foot total side yard variance to <br />construct new dwelling. Violation of Ord. 90-125, Section 1135.05. (Please <br />note: Proposal was heard by the Board of Building Code Appeals on September 26, <br />1991. Permission required to build on a lot 50 foot wide or less). <br />Chairnian Gomersall called all interested parties before the Board. The oath was <br />administered to Mr. Miller, and neighbors, Mr. and Mrs. Hosier, Mre and Mrs. <br />Mitchell, Mrs. Hixson, Mrs. Eichelberger, Mrs. Knight, Mrs. Dancy, Mrs. Ginn, Mr. <br />and Mrs. Gravenstreeter. Chairman Gomersall advised that this request had been <br />approved by the Board of Bui.lding Code Appeals on September 26th subject to the <br />this variance being granted and conditioned on the- Engineering Department's <br />approval of the site and drainage plans. Mr. Miller explained that it would be <br />impossible to build a house on a 40 foot wide lot without a variance being <br />granted.
