' `--- , <br />CITY OF NORTH OLMSTED <br />BOARD OF ZOIVING APPEALS <br />MINUTES--NOVIIKBER 711991 <br />Chairman Gomersall called the meeting to order at 7:35 p.m< <br />Present: B. Grace, T. Restifo, and R. Gomersall <br />Absent: J. Maloney. <br />Also Present: Law Director Gareau, Building Commissioner Conway, and <br />Clerk of Corrmissiozs Oring. <br />B. Grace moved to accept- the minutes of the October 2, 1991 as presented, <br />seconded by R. Gomersall, and unanimously approved. <br />Chairman Gomersall advised the applicants that there were only 3 members present <br />at this meeting and it would take 3 affirmative votes to approve their request. <br />Anyone wishing to delay his request until the next meeting should do so at this <br />time. . . <br />1. Ronald L. Klesh, 29540 Huntington Dr. <br />Request for variance (1123.12). Request variance to keep 4 foot fence <br />around rear yard containing in-ground pool (pool permit issued 4/17/75). <br />(Building permit for replacement fence issued 4/4/91 but application did <br />not show existing pool). Violation of Ord. 87-93 (previous code), <br />Section 1135.02(1). <br />Chairman Gomersall ca.lled all interested parties before the Board. The oath was <br />administered to Mr. and Mrs. Klesh, Councilman G. Nasher, and neighbors, Mr. and <br />Mrs. Balogh. Mr. Gomersall explained that the 4 foot fence was a replacement of a <br />previous fence. Mr. Klesh explained that the pool and fence were on the property <br />when they bought it, but the four foot fence had deteriorated. They contracted <br />with Landmart Fence Company who applied for the permit which was granted on April <br />19th. In August he was advised that he was in violation. Mr. Gomersall pointed <br />out that the when permit was issued there was no mention of the pool. Councilman <br />Nashar presented pictures which showed that the original fence was deteriorating. <br />Mr. Balough, the adjacent neighbor, stated that he preferred a 4 foot fence to a <br />6 foot fence. Mr. Gomersall commented that contractor should have lmown better. <br />Building Commissioner Conway advised that normally they have no problems with <br />Landmart Fence Company. Mr. Klesh stated that no one from the fence company would <br />attend the meeting. B. Grace moved to grant a variance to keep a 4 foot fence <br />around a rear yard containing in-ground pool (pool permit issued 4/17/75). <br />(Building permit for replacement fence issued 4/4/91 but application did not show <br />existing pool) for Ronald L. Klesh, 25940 Huntington Drive, seconded by R. <br />Gomersall, and unanimously approved. Variance granted. <br />2. Joseph L. DeSalvo, 4666 Brendan Circle. <br />Request for vaxiance (1123.12). Request 18 square foot variance and 4 foot <br />height variance for tool shed. Violation of Ordo 87-93, Section 1135.02(d)-1&3. <br />Chairman Gomersall called all interested parties before the Board. The oath was <br />administered to Mr. DeSalvo and a neighbor, Ms. Wasil. Mr. DeSalvo pointed out <br />that the 18 square foot variance as stated on the agenda was not correct since <br />this was a 16 by 24 foot shed. Building Commissioner Conway stated that this <br />would be a 184 square foot variance. Mr. DeSalvo advised that he will remove the <br />Pxlsting 8 by 10 foot shed. Ms. Wasil, the abutting property owner, is concerned <br />because there are no plans presented showing ma.terials, style, or type of door to <br />be installed. She also has a problem with calling this a tool shed, since it is a <br />two story building, and is a foot higher than the max;,m,m allowed for a garage. <br />1
