3 <br />evaluate the entire proposal as Mixed Use, not as retail. Mr. Gorris was <br />concerned that this might become a restaurant row and the area might have to be <br />rezoned to retail for a decision that was made earlier. Mr. Dubelko responded <br />that if there is enough information to evaluate the entire proposal and the <br />members are satisfied it can be integrated into the entire plan, that is not a <br />realistic fear. If the developer can demonstrate that these two restaurants ean <br />be integrated into the overall development of that pa.rcel and there is enough <br />information for an evaluation, there should not be a concern because two <br />restaurants are approved at the initial phase of the development. If economic <br />conditions change, there is nothing to stop the developer from seeking a <br />rezoning. Mr. Deichmann mentioned some concerns with the platting request, since <br />on the south side there is a limited access highway (I-480) and on the west side <br />there is a limited access highway (Great Northern Boulevard) on the north side, <br />and the east side of this parcel would abut the Biskind property, so in effect <br />this does not have frontage an a dedicated street for the purposes of access <br />since there is an approximate 15 foot wide strip on the north side, this parcel <br />does not have frontage on Country Club. Mr. Gavin stated that this strip was left <br />deliberately in the event of possible road widening and there will either be <br />easement granted or it will be conveyed to the City, this way.the City would not <br />have to go to other owners in the event the road was to be widened. Mr. Deichmann <br />stated that that there would be no objection if the property is conveyed to the <br />City. Mr. Papandreas, pointed out tha,t the only access to the Pierre Radisson, <br />was through Biskind Development and that was never an issue as long as there was <br />frontage along a public right of way. Mr. Deichmann stated that the Country <br />Recorders office had a problem with this. (Mr. Papandreas made some remarks which <br />could not be heard). Mr. Skoulis questioned the limited access restriction on <br />Great Northern Boulevard since this ha.d not been mentioned.during the d.iscussion <br />of the Buttemut Ridge Apartments. Mr. Deichmann responded that the limited <br />access restriction was from I-480 to Brookpark Road. Mr. Skoulis speculated that <br />Biskind Development must have received permission for a curb cut on Great <br />Northern Boulevard for Chester's. Mre Deichmann will check on thise Mr. Skoulis <br />and Mr. Gorris diseussed Mr. Dubelko's advice. Mr. Dubelko clarified that he did <br />not say that the Commission should approve this, he stated that, if. they are <br />going to approve this, there is an obligation to look at the factors that he <br />mentioned, integration, etco He did not say no other restaurants could be <br />approved down the line, the Commission must decide how many restaurants this <br />parcel can support, how many service establishments, and what constitutes <br />integration. This is for the Connission to decide. Mr. Gorris stated that his <br />concern was putting in the subordinate business before the primary uses were <br />approved. Mr. Dubelko responded that was what he was trying to say in January, <br />that there is an obligation for the developer to show how this is going to be <br />i.ntegrated into the plan, the Commission may or may not be given enough <br />information to evaluate anei determine that the proposed retail uses are <br />integrated into the area. Mr. Papandreas stated that this is wha.t was submitted, <br />the majority of the parcel will be developed as offiee, over 150,000 square feet, <br />that is their intent. They will be integrating all the uses along with the <br />landscaping, lighting, etc. They believe that theyhave integrated their other <br />properties very well. Mr. Gorris stated that previously, the offices were built <br />first, now it appears they are coming ba.ck with more and more subordinate uses, <br />he does not want to do anything that would force this to all become retail or end <br />up in the courts. Mro Papand.reas maintained that they ha.ve presented a plan, and <br />they should not be held to developing a certain area first. Mr. Weaver suggested <br />that perhaps the City should get an opinion from their own planning consultants. <br />Mr. Gavin pointed out that there are plans for the whole parcel, they are not <br />10
