construction would be repaired by the developer. PZr. Deichmann stated that there <br />is an ordinance requiring a bond for a truck route, and further stated that any <br />truck using a road it was not supposed to (using Canterbury instead of the haul <br />road), would be ticketed. This agreement must be negotiated between the Service <br />Director and Shore West. Mr. Bower clarified that it had been decided to use the <br />haul road during this phase of the construction, but there is a possibility that <br />they will use Canterbury in the future. Mr. Thomas believed that trucks would try <br />to use Canterbury, unless it was policed constantly. Mr. Matheny was concerned <br />that the residents of Canterbury would be assessed for an inproved road (it is <br />now a rural road) which will service both this development and Pebblebrook <br />Subdivisions. Mr. Gorris did not believe that residents would be assessed for <br />that. Mr. Deichmann mentioned several residential streets which have been repaved <br />and for which no assessment was made. Mr. Dubelko advised if assessments were <br />proposed there is a specific procedure which would be followed and all affected <br />residents would be notified. Mr. Thomas suggested that, as part of this approval, <br />the Commission could recommend to the Engineering and Service Departments that <br />the developer specify exactly what use is going to be made of Canterbury Roade <br />Mr. Kephaxt, the architect, explained to Mr. Skoulis that there will be the <br />min;m„m of 10 feet between buildings. He further advised Mrs. Orr, a resident of <br />Canterbury Road, that the minimu[n setback from her property line to the building <br />would be 50 feet. B. Gorris moved to approve the proposal to combine all parcels <br />comprising the North Olmsted Golf Course as delineated on the plan and to <br />resubdivide and designate the land as follows: A) North 0lmsted Golf Course lot <br />split and assembly plat; B) North Olmsted Golf Course Land Partition Plat; C) <br />View Point Development Plat - Vista Homes, 51 buildings; D) View Point <br />Development Plat - Golf Homes, 55 buildings. The location is west of Canterbury <br />Road and south of Butternut Ridge Road and I-480. Zoning is Single Family <br />Cluster, entirely, as per Ordinance Noe92-1. The proposal is contingent upon an <br />acceptable deed restriction as approved by our Law Department incorporating our <br />recommendations for those deed restrictions required in earlier Board approvals; <br />it is also recommended to Council and specifically to the councilman of this <br />ward, Dean McKay, that attention be paid to the use of Canterbury Road by trucks <br />for construction and other vehicles, and that some process be established by the <br />Council and the Service Department for the repair and upgrading of Canterbury <br />Road prior to that use so that this ha.s the least impact on the residents of <br />Canterbury, not only the financial impact, but also for nuisances this <br />construction will cause. It should also.be noted that an access easement onto <br />Canterbury Road will be required, seconded by J. Thoma.s. Roll call on motion: <br />Gorris, Thomas, Bowen, and Skoulis, Mr. Orlowski, no. Motion carried. <br />3) Developers Diversified, Ltd. and W. & Z. Properties, Ltd. Resubdivision Plat. <br />The proposal is to resubdivide parcels lA, 1B, and 1C of the previously approved <br />and recorded (Volume 257, Page 2 of Cuyahoga County Map Records) Developers <br />Diversified, Ltd. and W. & Z. Properties, Ltd. Resubdivision, and includes a <br />proposed dedicated street (Ord. 92-63). Location is the west side of Great <br />Northern Boulevard and south abutting I-480, and is the proposed Moen Corporate <br />facility site. <br />Chairman Gorris explained that tYie first issue would be resubdividing the <br />parcels as shown in the journal entry and the second would be accepting for <br />dedication the A1 Moen Drive. City Engineer Deichmann had reviewed it and advised <br />that he was not aware of any discrepancy between this plat and the journal entry. <br />Mr. Neff, engineer, and Mr. Berryhill, representing Developers Diversified, <br />presented the plans.
