Chairman Burk administered the oath to Richard Miller, Miller Brothers Builders, <br />who explained that they are proposing to build a single family, slab <br />construction, ranch style home, on sublot 300, Porter Road, a 40 foot wide lot. <br />He submitted information that the lot was deeded in 1$92 as a buildable lot, as <br />well as a list of other developed 40 foot wide lots on Porter Roado He explained <br />that it would be impossible to build a home on this property without variances <br />for square footage and setbacks. Building Commissioner Comaay suggested that a <br />two story home with less required square footage on the first floor could <br />possibly be built on the lot without variances. Mr. Miller believed that the <br />previous request had been tuzned down (by the Board of Zoning Appeals) because <br />the house was too high. Mr. Conway explained that these issues must be addressed <br />by the Board of Zoning AppPals, this Board must determine if there is going to be <br />an adverse impact on the ciraina.ge on adjacent properties since this lot is less <br />than 50 feet wide. The previous proposal had been approved by this Board, but <br />since the footprint of the building has changed, another hearing is needed. A <br />gradirg plan had been presented, and the Assistant City Engineer had advised that <br />he had no problem with the concept of the plan. Mr. Conway clarified that the <br />last time this appeared before this Board there had been a question about when <br />the lot had been subdivided, however according to his research this lot was in <br />PXlstence as is since before the 1950's. He explained that all the lots on the <br />street were platted at 40 foot originally and the two lots on either side were <br />combined with a portions of the lots on the opposite side. Councilman Nashar <br />questioned the drainage and how it would effect the neighbors' property. Mr. <br />Conway called in Assistant City Engineer McDermott who was in another meeting. <br />Mr. Ka.zak pointed aut that the grade was not being changed, it would be within <br />inches of the adjacent grades. Mr. McDermott stated that he had reviewed the <br />drainage plan, but had not checked the site. He saw no adverse conditions, the <br />property could be drained. The Engineering Department will require a backyard <br />inlet, and when a more detailed plan comes in the drainage must be approved. Mr. <br />Mitchell and Ms. Schmidt, adjacent neighbors, were sworn in at this time. Mr. <br />Mitchell studieci the list of houses built on 40 foot lots, and was advised that <br />these houses are on South Porter only. Whether they had needed variances would <br />depend an when they were built. Mr. Mitchell stated that his Yiouse floods every <br />time it rains, and there is a problem with the drainage on the street with <br />standing water in front of his house. Mr. McDermott stated this proposal might <br />add a small amount of water run off, but it would not increase the problem by <br />much. It would appear.that the problem is with the storm sewers. Mr. Miller <br />questioned why the City has not corrected it, and further stated that his lot ha.s <br />standing water now, but when it is graded properly, the water will drain to the <br />front. Mr. Burk believed that a new home owner is being penalized for an existing <br />problem. Mr. McDermott pointed out that part of the problem was that there are <br />ditches instead of enclosed pipes. Mr. Kazak stated that the Engineering <br />Department must determine how great a-hardship there will be for the neighbors. <br />Councilman Nashar advised that there have been problems with slab.homes flooding <br />for some time, and the Service Department is in the process of correcting these <br />drainage problems though out the City. This area should be addressed some time in <br />1992. Mr. Mitchell stated Yne had everything in his ba.sement up on cement blocks, <br />and believed that when this house is built lie would have a greater problem. But <br />drainage is only one reason that he is opposed to this, he is also concerned <br />because the lot is so small. Mr. Schultz stated that this Board must address <br />health, safety, and welfare, and he does not believe building in the area would <br />help the welfare of the resiclents. Chairman Burk admi.nistered the oath to Steven <br />Miller, who is going to buy the house, and stated that he has a lot that he <br />2
