that he will be living in the house. Mrs. Bahas had several concerns: that the <br />garage is only 10 feet wide, that variances will be needed for the square <br />footage of the house, and that a tree on the lot which provides drainage.will <br />have to be removed. Mr. Miller presented a docunent from the county showing <br />lot size, and size and type of homes that are now on the street. He maintained <br />that this house will be in keeping with the other homes in the area. Several <br />neighbors disagreed with tYie figures he presented, since these records show 52 <br />foot lot, and their lots are 60 feet wide. Mrs. Bahas stated that the plat map <br />showed that most of the lots were 60 foot. This issue really has no bearing on <br />this hearinga Mr. Burk stated that the request was approved at the last <br />meeting conditioned upon advice from various City Departments that there would <br />be proper drainage in the a:rea and tha,t building on that lot would not create <br />a hardship to the neighbors with regard to drainage. He stated that the <br />information received from the City seemed to indicate that there would not be <br />a problem. Mrs. Gravenstreter, a resident, disagreed with the Assistant City <br />Engineer's statements. She maintained that water did overflow the ditches and <br />did get into basements and she wants the situa.tion remedied before the house <br />is built. She had not seen anyone from the City on the street recently. She <br />explained that there were surveyors on the street last sunmer at which time <br />they were told that their pr.oblen would be solved, but it has not been. AZrs. <br />Hosier stated that there was standing water in the 1ot next door even when it <br />is not rauzing. Neighbors would like Mr. McDermott to come out after it rains <br />and believed that a representative from the Engineering Department should have <br />been at the meeting. The members studied the plat map and the previous <br />minutes. Building Commissioner Conway advised that the size of the house was a <br />ma.tter for the Board of Zoning Appeals. Mr. Miller stated that they had <br />presented a site plan showing the elevations to the Engineering Department. <br />Mr. Kazak read the motion from the last meeting "Mra Schulz moved that the <br />Board table this proposal until the topographical ma,p is received and after <br />the Engineering Department has approved it, the Board will act on the <br />proposal". That motion fai:Led... Then a motion was made to accept construction <br />of the dwelling pending variances being granted by the Board of Zoni.ng Appeals <br />and conditioned an the Engineering Department's approval accepting a site plan <br />and drainage plan as it was submitted at the meeting. This motion did pass. <br />Mr. Kazak stated that if this letter is accepting the drainage plan by the <br />Engineering Department then that would complete the motion to accept by this <br />Board. Mr. Conway stated that they have not filed for a variance as yet. Mr. <br />Miller stated that he planned to file after the results of this meeting, but <br />he tmderstood from the letter that he had to wait to build the house until <br />after the ditches were cleaned. Mrs. Gravenstreter stated when they built <br />their home they were told i:hat the ditches would be replaced by pipes in 1987 <br />after their assessment was paid for. Mr. Miller believed that this was the <br />only solution to their problem. She ma.intained that most neighbors would be <br />willing to pay for this, but they were told by the former mayor that the <br />neighbors would have to get together and request it, and there would be a few <br />neighbors who would object to paying for the improvement. Chairman Burk stated <br />that, in his opinion, the letter from the Engineering Department did not <br />actually accept the propos3l, his interpretation was that this was a rather <br />quick review and he did consider it to be conclusive that this proposal would <br />cause no problems to the svrrounding neighbors. Mr. Kazak stated that there <br />were two conditions in the motion that was made at the last meeting: one was <br />contingent upon Engineering Department's approval accepting the site plan and <br />the drainage on the plan that was submitted at the last meeting, and the other <br />was that a variance must be granted by the Board of Zoning appeals.
