At the previous meeting it was stated that Mr. Miller's brother and <br />his family were to live in the house, now this Mr. Nliller will be living in <br />it. Mr. J. Miller resporided that he gave his brother one of his houses. It was <br />clarified that there was nothing in this correspondence about installing <br />culverts, only that the ditches will be regraded. Mrs. Gravenstreter stated <br />that regrading was done last sturmier and she maintained they dug her ditch so <br />deep she cannot get anything out of it and that there is more standing water <br />than ever. Mr. Kazak stated that since neithex of the requirements of the <br />motion of February 27th have been met, the Board carn7ot act an this.. These <br />requirements must be met before the Board can act. The neighbors were advised <br />that they could contact City Engineer Deichmann at the City Hall between 8:30 <br />a.m. and 4:30 p.m. Mr. Burk explained to Mr. Miller that until the Board could <br />get conclusive information from the Engineering Department tha.t construction <br />on his property will not create a hardship on the neighbors the Board can not <br />proceed. He believed that the information that was presented tonight was not <br />conclusive since there has not been sufficient time to present anything' <br />conclusive. Mr. Kazak stated tYiat basically the Board just needs Engineering's <br />approval of the site plan and drainage pl-an, and that the variances would also <br />have to be approved by the Board of Zoning Appeals. He questioned how that <br />Board could approve something that this Board has not approved. Mr. Conway <br />clarified that this Board made approval pending approval by the Board of <br />Zoning Appeals, once he gets the Engineering issue settled, he could apply to <br />the Board of Zoning Appeals, and as soon as B.Z.A. approves this it would meet <br />the second condition of this approval. Mr.. Miller questioned if they can build <br />before the ditches are done. Mr. Conway suggested that they contact Mr. <br />McDermott directly clarify that. Mr. Conway also advised that, he would like to <br />verify the Tist which Mr. NLiller presented since apparently it was inaccurate. <br />NEW BUSINESS: <br />No items. <br />OLD BUSINESS: <br />Discussioris of modifications to the 1989 G.A.B.O. One and Two Family Dwelling <br />Code and the 1990 and 1991 amendments. <br />The members reviewed and'discussed the modifications to the 1989 code and the <br />amendments to the 1990 and 1991 codes and made several changes (see attached). <br />The members ha.d no other suggestions. B. Kazak moved to adopt the changes to <br />the 1989 C.A.B.O. One and 'I?ao Family Dwelling Code and the 1990 and 1991 <br />amendments as stated, seconded by W. Pi:ar, and tmanimously approved. Building <br />Commissioner Conway will ha.ve these changes put into ordinance form and he <br />will invite the contractors to the public heari.ng. <br />ADJOURNMIINT : <br />The meeting was adjourned at 8:45 p.m. <br />3
