CITY OF NORTEI OLMSTED <br />BOARD OF BUILDING CODE APPEALS <br />MINUTES - APRIL 30, 1992 <br />I. ROLL CALL: <br />Vice Chairman Kazak called the meeting to order at 7:30 p.m. <br />Present: J. Kazak, W. Piar, and D. Spoerke. <br />Absent: R. Burk and B. Schulz <br />Also Present: Building Commissioner Conway, and substitute Clerk of Commission <br />Wingenfeld. <br />II. REVIE[q AND CORRECTION OF MINUTES: <br />J. Kazak moved to approve the minutes of February 27, 1992, seconded by W. Piar, <br />and unan:i.mously approved. <br />III. COMMUNICATIONS: <br />No items. <br />N. HEARINGS: <br />1) Sami Najjar, 26473 Sweetbriar Drive <br />Seeking variance to North Olmsted Plumbing Code (Ohio Plumbing Code) for plumbing <br />fixtures all ready installed without venting. Would seek approval of installation <br />as permitted by the former North Olmsted Plumbing Code (Regional Dwelling House <br />Code) <br />Vice Chairman Kazak administered the oath to Mr. and Mrs. Najjar, Mrs. Champion, <br />neighbor, and L. Cifranic, Plumbing Inspector. Building Commissioner Conway <br />advised that this variance was being requested from the North 0]msted Plumbing <br />Code, not the Ohio Pltunbing Code since this Board could not grant that variance. <br />It was clarified that the 1968 date mentioned on the application was the date <br />that the conversion was made from a septic tank to the sewer system. Mrs. <br />Champion, a neighbor, stated that the Najjars were not aware that they needed a <br />permit to remodel a basement. She maintained that when she did the same thing, <br />many years ago, she was tmaware that a permit was needed. Mr. Najjar stated that <br />he did go to the Engineering Department to get a permit to find out where his <br />sewer lines were. Mr. Conway advised that the Building Department went to his <br />roan in response to a complaint fron a neighbor that they were adding bedrooms in <br />the basement. Mr. Najjar advised tha.t they were putting in a playroom and did not <br />lmow that a permit was needed. At that point the plinnbing had been installed, and <br />and the inspector had ordered it removed. Since they were having a party,he went <br />ahead and tiled the floor. 14r. Cnnway advised that there would be two <br />alternatives, one would be to tear up the floor and take it aut or this could be <br />approved under the former code North Olmsted Code which did make exception for <br />venting in certain circumstances where plumbing is below grade. They had <br />determined that it would have been feasible to install it this was under the old <br />code. Mr. Cifranic advised that it appeared that the plumbing was operable, but <br />they did not see it before it was covered. Mr. Conway stated that he had <br />corrected all of the other installations such as electrical, this is the only <br />issue, and the Building Department has no objection to the variance being granted <br />as long as Mr. Najjar is aware that he is responsible for what is Lmderground. D. <br />Spoerke moved to grant a varianee to Mr. Najjar, 26473 Sweetbriar Drive, to the <br />North Olmsted Plumbing Code for plumbing fixtures all ready installed without
