.- , <br />CITY OF NORT?i OLMSTED <br />BOARD OF BUILDING CODE APPEALS <br />MINUTES - MAY 281 1992 <br />I. ROLL CALL: <br />Vice Chairman Kazak called the meeting to order at 7:30 p.m. <br />Present: W. Piar, B. Schulz, and J. Kazak <br />Absent: R. Burk and D. Spoerke <br />Also Present: Chief Building Inspector Sanker and Clerk of Commissions Oring. <br />II. REVIEW AIVD CORRECTION OF MINUTES: <br />The minutes from the April 30, 1992 were deferred. <br />III. COMMUNICATIONS: <br />Vice Chairman Ka.zak read a letter from Building Commissioner Conway to Chairman <br />Burk regarding the agenda iteln for tonight (attached). <br />IV. BEARINGS : <br />1) Kanareff Homes, Inc., property located between 5454 and 5474 Whitehaven Ave. <br />Request permission to construct dwelling on permanent parcel rnunber 236-18-69/51 <br />s/1 265 Whitehaven Ave. ("C" District, minirrnnn lot frontage 60 feet)o Hearing <br />required by Ord. 2806 (any house being built on a lot with a 50 foot front width <br />or less requires the approval of the Board of Building Code Appeals). <br />Vice Chairman Kazak administered the oath to Mra Sajna, representing the <br />builder; and to Mr. Matuszak, Mr. Wagner, and Mr. Hienton, adjacent property <br />owners. Mr. Sajna, showed the plans to those present and explained that they will <br />be constructing a 3 bedroom, aluminun sided ranch home with a full basement and <br />an attached 2 car garage. This lot is low and the neighbors explained that the <br />drainage appears to run from south to the north and most of the water is just <br />absorbed, very little water drains to the ditch in the front. Mr. Wagner stated <br />that their biggest concern is the drainage since there is standing water at <br />times. Mr. Kazak believed that after this house is constructed with proper <br />grading, maales, and yard drains, their, drainage problems might be improved. <br />Mr. Matuszak stated that there was a large garage built a few years ago and it <br />drains into a swale and the water just stays there and they also have severe <br />mosquito problems. Mr. Wagner is concerned because after the grade is approved, <br />the residents of this property will add top soil and then the grade wi11 be <br />higher than his. It was explained that the'finished grade will be approved after <br />the top soil is added. Mr. Wagner asked what recourse he would have if, after <br />this house is built, and he gets water in his basement. He would like the <br />builder to put up a bond for along enough tiune so that can be determined that <br />his basement will not flood. It was explained that a bond is required until the <br />Engineering Department has approved the final grade. Mr. Wagner would like the <br />bond held for a full year after the house has been inspected to insure that his <br />basement stays dry in the spring. He advised that the builder never returned his <br />call when he wanted information, and is concerned tha.t if he had a problem he <br />woulcl get no satisfaction. Mr. Sanker explained that the Engineering Department <br />required the bond, so that would be up to them. Mr. Kazak stated that normally a <br />bond lasts a year. It was explained that.this lot would probably be built up to <br />match the neighbors grade, and a yard drain would probably be required. Mr. <br />Matuszak submitted a deed which showed that this lot originally sold as a 100 <br />1
