13. J. E. J. Cornpany, 3640 West 232 Street. <br />Request for variance (1123.12)a Request 21 foot rear yard variance to construct <br />new dwelling. Violation of Ord. 90-125, Section 1135.08(a). Also request 4 foot <br />variance for distance between dwelling and detached garage on adjacent property. <br />Violation of Ord. 90-125, Section 1135.02(c)2. <br />Chairman Gomersall ca.lled all interested parties before the Board. The oath was <br />administered to Mr. Ramos, and Jack Kilroy, representing J.E.J. Company, Nir. and <br />Mrs. Kilroy, who own the lot, and neighbors, Mr. and Mrs. McAllister, Mrs. <br />Sostakowski, and Mrs. 0'Dee. Mr. Ramos presented pictures of this house which he <br />had built previously at another location. The side yards will conform but since <br />this house is 56 feet deep with an attached garage, a variance will be needed. <br />In order to build a conforming -house it could only be 34 by 36 feet which would <br />be smaller. If there zaere a detaehed garage, it would have to be adjacent to <br />another garage and would take up a good deal of the back yard. He pointed out <br />that there would be 66 feet from the rear of the attached garage to the property <br />line and 29 feet from the rear of the house to the property line, and that <br />variances had been granted to build several additions in the neighborhood. 1he <br />neighbor to the rear had no real objections, but was concerned about the short <br />rear yard. Mr. Gomersall has concerns about this size variance. The neighbors <br />are concerned that the trees on the property line might be destroyed during the <br />building. Mr. Ramos would like to save as many of the trees as possible, but he <br />cannot guarantee that they can be saved. Mr. Conway advised him to contact the <br />City forester. Law Director Gareau stated that the Board must consider the size, <br />shape, and topography of the land, and also that if the garage were to be in the <br />back, it would be 10 feet from the rear iine, and more trees would have to be <br />removed. This way there is a green area an the side. Mr. Ramos stated that he <br />cannot build a smaller house and have it in keeping with the rest of the <br />neighborhood. None of the neighbors were really objecting since it is a small <br />lot. W. Purper moved that the request be granted to J.E.J. Company 3640 West 232 <br />Street, for a 21 foot rear yard variance to construct new dwelling and a 7 foot <br />variance for distance between dwelling and detached garage on adjacent property, <br />seconded by J. Maloney, and Lmanimously approved. During the motion, Mr. Conway <br />advised that fire walling the house would accomplish nothing. Variances granted. <br />14. Ken Kar y, 23138 Stoneybrook. <br />Request for variance (1123.12). Request 29. square foot area variance, request <br />2 foot variance for side property line setback and 4 foot variance for rear <br />property line setback to replace existing shed. Violations of Ord. 90-125, <br />Section 1135.02(d)(1) and (4). <br />Chairman Gomersall called a11 interested parties before the Board. The oath was <br />administered to Mr. Karpy. The members had no problem with the request. R. <br />Gomersall moved to grant the request to Ken Karpy, 23138 Stoneybrook for a 29 <br />square foot area variance 3 faot vaxiance for side property line setback and 4 <br />foot variance for rear property line setback to replace existing shed, seconded <br />by J. Maloney, and unanimously approved. Variance granted. <br />A letter from Society Bank had been sent to the members asking if they could <br />replace their signs during the ehange over prior to their variance request being <br />heard.. Mr. Gomersall is against doing this. Building Commissioner Conway <br />explained that'this was held up because the sign company representative dropped <br />off the application and went on vaeation and could not be told that he needed a <br />variance. Law Director Gareau stated that this is not going to make much <br />difference in the appearance of the City. The signs will say Society instead of <br />Ameritrust, and since some of the branches are closing, this would at least let <br />7
