Law Director Gareau stated that there is a provision that <br />when an business moves out the grandfather provisions do not apply to the next <br />business. Mr. Yousef believed that the members ha,d made up their minds tha.t they <br />are not going to approve his signs and pointed out that these signs were 27 <br />square feet under wha.t would be allowed, and a11 he had done was to replace <br />.? , faces. He presented pictures of other buildings and signs which were not were <br />not in good condition. Mr. Gareau stated that it was unfair to aecuse the Board <br />of picking on him, since month after month other businesses ha.ve to come before <br />the Board to attempt to get variances. He pointed out other businesses who had <br />changed their requests to conform to the ordinances. Mr. Yousef explained that, <br />in his previous location, Mr. Bis stole his sign one day after his variance had <br />expired. He again stated that Mr. Bis was prejudiced against him. In reference <br />to the awning he stated that lights under the awnings are on timers and are not <br />lighted tmless it gets dark and haVe only been on once this summer. If he can <br />get a tax abatement he will do anything the Board wants. Business at the old <br />location had increased after the ternporary signs were in place, and there ha.d <br />been a sma.ll increase in business sinca 'they moved to this location, but after <br />the window sign,was installed in the present building, their business increased <br />by 25%. He has' 4 employees now and will be hiring 2 more whicli will bring in <br />more taxes to the`City and should be considered. Mr. Grace stated that he had no <br />problem with these signs, and pointed out that other stores had window signs. <br />Mr. Maloney ha.d a problem with the back ]it awning. Mr. Gomersall stated that <br />the two requests will be voted_ on separately. B. Grace moved to approve the <br />request for Auto Accents, 25021 Lorain Road to use an existing pole sign with <br />the condition that it must be removed by January 1, 1998, seconded by R. <br />Gomersall, and unanimously approved. Variance granted. In reference to the <br />awning, it was explained:tha.t other back lit awnings have been disapproved by <br />PlarLning Commission. The members also believed that this lighting could be a <br />problem'to the adjacent residents. Mr. Yousef advised that he removed lights on <br />the back of his building which he thought would disturb the neighbors. B. Grace <br />moved to approve for Auto Accents, 25021 Lorain Road, the request for a devise <br />(back lit awning) visiblF from a public way and designated to direct attention <br />to a btuilding, seconded by R. Gomersall. Roll call on motion:.Mr. Grace, yes. <br />Mr. Gomersall and Mr. Maloney, no. Variance denied. Mr. Yousef asked if he could <br />have the lights facing down instead of up toward the awning. Mr. Gareau stated <br />if the lighting did not constitute back lighting, was not visible from the <br />street, and did not call.attention to the building, it should be approved. Mr. <br />Sanker advised that a perrnit must be obtained to do the electrieal work, and at <br />tha.t time the Building Department can see if the lighting would be acceptable. <br />Carol Zipfel, 29189 Quail Run <br />Request for variance (1123.12). Request 18 inch variance to install fence in <br />corner lot setback. Violation of Ord. 90-125, Section 1135.02(f). <br />Chairman Gomersall called all interested parties before the Board. The oath was <br />administered to Ms. Zipfel who presented a revised plan with a section of 5 foot. <br />fence which would shield headlight from tlleir property. It was clarified that <br />there would be 17 feet of 5 foot fence (a?12 foot section and a 5 foot section) <br />whieh would be installed around a tree. The members had no problem`raith the <br />request.. R. Gomersall moved to grant the request of Carol Zipfel, 29189 Quail <br />Run, for an 18 foot variance :to install a fence in a corner lot setback arid?to <br />include 17 rimning feet of 5 foot:high fence in the south west corner, seconded <br />by B: Grace, and imaxLmously approved.
