Request variance to remove.an existing garage <br />and not replace it., Violation of Ord. 90-125, Section 1161.08(a)l. <br />Chairman Gomersall ca,lled a11 interested parties before the Board. The oath was <br />? administered to Mr. Pack and Ms. Fishera, tenants, who explained.that they were <br />authorized to represent Ms. Van. Mr. Pack explained that the garage was removed <br />2 years ago prior to their moving in and since the house is for sale as <br />commercial property, a new gaxage would be a large investment which would not be <br />necessary. He advised that there is a concrete pad adjacent to the.house for <br />parking. The members had no problem with the request. R. Gomersall moved to <br />- grant the request for Elizabeth Van, 30993 Lorain Road for a variance not to <br />replace a garage which has been removed, seconded by B. Gomersall, and <br />unanimously approved. Variance granted. <br />3. Dr. Yong H. Jung, 25566 Lorain Road. <br />Request for variance (1123.12). Request 3 foot side yard variance from the <br />structvre on east property line and 7 foot side yard variance from the drive off <br />, west property li.ne (10 feet required); and also request 6 foot 9 inch variance <br />for side yard variance for parking area adjacent to residential area. Violations <br />of Ord. 90-125, Section 1139.07. Heard by Planning Commission an July 28, 1992. <br />Chairman Gomersall called all interested parties before the Board. The oath was <br />administered to Dr. Jung, owner, and Mr. Porter, arehitect, who presented a <br />revised plan which includes the 20 foot landscaping buffer in the front. He <br />explained that there may be an error on the zone line of the ad jacent property, <br />which will have to be verified with a legal description. This is in the axea <br />where the vaxiance is being requested. Mr. Gomersall had a problem with the <br />variance in tha.t area since it is adjacent to residential property. Mr: Grace <br />stated that these residential lots 'are quite deep. Mr. Porter presented <br />photographs of the adjacent properties and advised that the new..plan has <br />eliminated the variance from the residential side, but would extend the.variance <br />an the west side of zhe prqperty. The home to the west is owned by Mrs. Thomson, <br />who was present. Mrs. Thomson and Mr. Passant, who owns the property to the <br />east, were sworn in at this time. Mrs. Thomson's coneern was that might devalue <br />her property. Since her property is commercial-, neither Mr. Grace or Mr. <br />Gomersall believe-tha.t this would reduce the value. Mr. Gomersall pointed out <br />that this is an irregularly sha.ped lot. Mr. Passant suggested that a they build <br />a 3 story building so it would not need so many variances. Mr. Porter responded <br />that this would require that an elevator be installed, and advised the Board <br />that Mr. Passant has tried to buy the rear.portion of Dr. .7ung's property. Mr. <br />Passant stated that he is interested in.developing. his residential property <br />which will back up to this lot. Mr. Porter explained to.LaNv Direetor Gareau that <br />the parking is being figured of ha.vi.ng one doctor' s office and the balance as <br />normal office use. If other med.ical.offiees are put in, additional spaces may be <br />required. Mr. Gareau suggested that they might laridbank.some spaces. Mr. Porter <br />also advised tha.t there is a. ditch on the rear of this property. Mr. Grace <br />pointed aut that Dr. Jung has maintained this property well, and he did not see <br />the problem with a residential area backing up., to this lot. Mr. Porter <br />speculated that, since Mrs.. Thomson's property is the same sha.pe as Dr. Jung's, <br />a variance might be needed by a future buyer of her property, and it might be-to <br />her ad.vantage if Dr. Jung's property received a variance. The members agreed <br />thatthey would be willing to rule.on the amended planwhich have no variances <br />adjacent to the residential ares. , B.. Grace moved to. grant to Dr.. Yong . Jung, <br />25566 Lorain Road,` a 3 foot szde yard variance from the structure on east <br />property line and a 7 foot side yard variance from the drive.off the west <br />property line (10 feet required), seconded by J. Maloney, and tnanimously <br />approved. Variances granted. .
