Request variance to conduct temporary business <br />activity in tents in the required 75' setback, and a variance to display pennants <br />and banners for a 2 day period. Violations of Ord. 90-125, Sections 1139.07 (table) <br />and 116M4(g). <br />Chairman Gomersall called all interested parties before the Board. The oath was <br />administered to Mr. Jirecek, the proprietor, who explained he will need a tent for a <br />4 day period, one day to set up, two days for the car clinic, and 1 day to take <br />down. He also would like. some pennants and banners which would be nm down the light <br />poles and from the fence. There may be some signage on the tents. Mr. Grace pointed <br />out this was a well kept business. S. Ferencik moved to grant a variance to the <br />Lorain Clague Sunoco station at 23370 Lorain Rod for a variance to conduct temporary <br />business activity in tents in the required 75 foot setback and a variance to display <br />pennants and banners for a 4 day period (1 day to set up, 2 days for the program, <br />and 1 day to tear down the equipment), seconded by R. Gomersall, and unanimously <br />approved. Mr. Jirecek explained that he would hold this on these days regardless of <br />the weather since the equipment had been rented for those days only. Variances <br />granted. <br />Building Commissioner Conway explained that since the Board had previously requested <br />his opinion on signs, he had a problem with the Habitat request which originally was <br />200 percent over and above what is permitted. They then negotiated down to 100 <br />percent over and this could set a precedent for other applicants to request much <br />more than what is allowed and then reduce it slightly. Mra Gomersall stated that he <br />he agreed to it because the proposed renovations were such an improvement to that <br />part of the shopping center. r1r. Conway stated that if the sign area allowed is <br />inadequate, the ordinance should be changed, or if there was a strong reason such as <br />visibility granting the variance would be different, however, he had problems this <br />large a variance. Law Director Gareau suggested that if Mr. Conway believed a <br />request was excessive perhaps he should put a note in with the agenda to that effect <br />to alert the Boardo Mr. Gomersall agreed that would be helpful. Mr. Conway stated <br />that some of the other tenants who are on the existing sign band may want larger <br />signage, since with the remodeling they are i.ncreasing the area in which this <br />business can install signs. <br />In regard to the Halleen proposal, Mr. Conway further advised that they have also <br />installed some C.E.I. lights in the right of way which do not require a permit. <br />Since he cannot establish that these lights are causing any problems to the adjacent <br />neighbors, there is no way he can send him to Planning Commission. Law Director <br />Gareau also believed that there is a real omission in the new code, since it does <br />not stipulate that a used car lot has to be connected with a new car lot, and only <br />stipulates that such a business only needs a show room. He also pointed out that the <br />old Peddlers Outlet building has been divided in half in order to use one half for a <br />show room, he doubts he can get a car in it. Mr. Conway stated that he did have one <br />car in it. Mr. Gareau stated if there is ever a time when there is not car in it, <br />the business should le shut down. • <br />5 <br />7 <br />The meeting was adjourned at 9:40 p.m.
