Also request 10 foot side yarcl variance for parking <br />lot. Violation of Ord. 90-125, Section 1118.02F-2-C. <br />Proposal heard by Planning Commission on May 4, 1992 and will return on June 9, <br />1992. <br />Chairman Gomersall called all interested parties before the Board. The oath was <br />administered to Father Flynn, Ms. Baloug, neighbor, R. Kacmarck, contractor, and <br />Mre Za.rzycki, architect. ivfr. Gomersall had no objections. In response to Mr. <br />Graces question, Mr. Kacma.rck stated tha.t they have met Metro Parks and it <br />appears that they Frill relax their restrictions. Members questioned if a variance <br />could be granted. without Metro Parks approval. Law Director Gareau advised that <br />the City has no right to enforce a restrictive deed covenant. Mr. Zarzycki <br />presented a rendering of the structure which will be 18 feet from the rear <br />property line and will be slightly recessed. It was explained to Ms. Baloug that <br />the side yard variance was for the parking area and they did_own the adjacent <br />property, but have not consolidated it as yet. Ms. Balough had no objection to <br />the proposal. B. Grace moved to grant the request of the Church of St. Clarence, <br />30106 Lorain Road, for a 57 foot rear yard variance, a 6 foot height variance to <br />construct a pavilion, and also the request for a 10 foot side yard variance for <br />parking lot, seconded by W. ]?urper, and lmanimously approved.
