Mrs. Jundi explained that she needed a 5 or 6 <br />foot fence to keep her young children in the yard. Mr. Early explained that her <br />side yard was his front yard and since his house sits back, it would not look <br />right to have a fence in half of his yard. He stated that the fence in the front <br />half could be lower if there was a concern about visibility. Mr. Maloney is <br />concerned since, i:f the fence comes all the way down to the sidewalk, there would <br />be danger to children, and he believed that there should be some setback. Chief <br />Building Inspector Sanker stated that a fence in the front setback could only be <br />30 inches. Mr. Modenbock stated that he agreed that the fence should be tapered <br />down to the front side walk. It was clarified that this fence would not be <br />installed adjacent to an existing fence and further that the fence would be a 5 <br />foot then taper down to 30 inches and then go down to the sidewalk. Mr. Sanker <br />stated that the fence in the front would have to be 50% open. J. Maloney moved to <br />approve the request for Nuha H. Jundi, 6198 Fitch Road, for a 35 foot front <br />setback variance to place a fence in side yard of corner lot which is in the <br />front setback of the adjacent lot with the condition that the fence be 5 feet <br />high to the corner of the house and then from the corner of the house to the <br />property line on Bellevue Drive (one foot inside the sidewalk) the fence will be <br />reduced to 30 inches high to meet the City standards, seconded by B. Grace, and <br />unanimously approved. It was clarified that the fence could taper down to 30 <br />inches. Mrs. Jundi agreed to keep the fence 500 open. Variance granted. <br />5. Kevin Kilbane, 4134 Brendan Lane. <br />Request for variance (1123.12). Request 48 foot variance to place fence in side <br />yard of corner lot which is in front setback of adjacent lot. Violations of Ord. <br />90-125, Sections 1135.02(f)2 <br />Chairman Gomersall called all interested parties before the Board. The oatli was <br />administered to a neighbor, Ms. Krestel, and Mr. Kilbane who explained that he <br />wanted a picket fence and it would be installed 2 feet off the sidewalk. Chief <br />Building Inspector Sanker advised that a fence beyond the building line could <br />only be 30 inches high and must be 50% open. It was elarified that the fence <br />would have 2 inch slats saith 2-inch openings. The height of the fence was not <br />stated in the agenda notice. Mrs. Krestel, who lives across the street on <br />Cedarwood, objected to the fence because she would see it from her front door. <br />She would prefer a chain link fence. Mr. Gomersall believed that the fence <br />should be lower and not so close to the sidewalk. Mr. Grace had no problem since <br />it was open and was low profile. B. Grace moved to grant the request of Kevin <br />Kilbane, 4134 Brendan Lane for a 48 foot variance to place 4 foot fence in side <br />yard (will be 50% open) which is in the front setback of the adjacent lot, <br />seconded by R. Gomersall. Roll call on motion: Grace, Ferencik, and Purper, yes. <br />Mr. Gomersall .and Mr. Maloney, no. Motion carried. Variance granted. <br />6. Request 4 foot variance for location of ground <br />sign fran front property linea Violation of Ord. 90-125, Section 1163.12(b). <br />Chairman Gomersall called all interested parties before the Board. the oath was <br />administered to Mr. Fletcher, sign contractor, who explained that there was not <br />enough room to put the sign in a conforming location, they will have to put in <br />some kind of barriers around the sign to keep drivers from ninninv into it. S. <br />Ferencek moved to grant the request for Stylin' Concepts at 29919 Lorain Road, <br />for a 4 foot variance for the location of ground sign from front property line, <br />seconded by W.
