Robert Szule, 6032 Porter Road. <br />Request for special permit (1123.11) Request special permit to add to <br />non-conforming garage (3 foot side yards, 5 foot required). Special permission <br />required Ord. 90-125, Section 1165e02(b). <br />Chairman Gomersall called all interested parties before the Board. The oath was <br />administered to Mr. and Mrs. Szule. Mr. Gomersall read the building inspector's <br />comments regarding problems with the existing concrete pad which, in his opinion, <br />is not suitable for rebuilciing. Mr. Szule explained that a previous owner had <br />added to the pa,d, but he took this out and poured a new section. Building <br />Commissioner Cornaay stated that because a 5 by 5 foot section was replaced and <br />not tied into the existing or reinforced, this slab will not float as required. <br />The Building Department bElieved that it is senseless to put an addition on <br />something which will deteriorate over time. Mr. Szule stated that he could not <br />afford a new pad at this tijne. Mr. Conway suggested that if this Board wanted to <br />address only the zoning iss1aes, Mr. Szu1e could appeal to the Board of Building <br />Code Appeals regarding the code violation. He clarified that, even if a zoning <br />variance is granted, the structure must comply to the building codes. B. Grace <br />moved to grant the request for a special permit to add to a non-conforming garage <br />(3 foot side yards, 5 foot required) for Robert Szu1e, 6032 Porter Road, with the <br />stipulation that the addition must conform to North 07msted building codes, <br />seconded by R. Gomersall, and imanimously approved. Special permit granted. <br />11. Robert G. Sharp, 25407 Butternut Ridge. <br />Request for variance (1123.12). Request for encroachment of structures into <br />through lot setback: 5 foot variance for addition and 35 foot variance for garage <br />and a variance for a 6 foot fence entirely in setback. Violations of Ord. 90-125, <br />Section 1135.08(b)3. Also request 309 square foot variance and 2 foot height <br />variance for garage. Violations of Ord. 90-125, Section 1135.02(c)l. Request <br />special permit to add to non-conforming dwelling. Special permission required <br />Ord. 90-125, Section 1165.02(b). Please Note: storage of recreational vehicles on <br />property not permitted. <br />Chairman Gomersall called all interested parties before the Boardo The oath wa,s_ <br />administered to Mr. Sharp and Mr. Waldron, designer. It was noted that tlie <br />address should have been 25407, not 253 as stated. Mr. Sharp explained that since <br />Route 252 was constructed next to his house, he has had many problem with <br />litter, accidents, and vandalism. He needs some kind of buffer from the road. The <br />fence will keep some of their lawn from being littered, and the garage has to be <br />as shown in order to park a car in it, and the height is to match the structure. <br />He explained that the existing garage will be converted to a hobby room, the <br />garage door will be removed, but the drive will remain. Building Commissioner <br />Conway stated that if this is a case the 309 square foot variance would not be <br />required, but the site plari should be changed to reflect this.
