, ,r?- <br />CITY OF NORTEi OLMSTED <br />BOARD OF ZONING APPEALS <br />MINUTES--NOVIIHBER 5, 1992 <br />Chairman Gomersall called the meeting to order at 7:35 p.m. <br />Present: B. Grace, T. Koberna, J. Maloney, W. Purper, and R. Gomersall. <br />Also Present: Law Director Gareau, Building Commissioner Conway, and Clerk of <br />Conunissions Oring. <br />J. Maloney moved to approve the minutes of October 7, 1992, seconded by B. Grace, <br />and unanimously approved. <br />Chairman Gomersall advised those present that it would require 3 affirmative <br />votes to approve a proposal; that each request would be approved based on the <br />physical situation peculiar to itself and no Judgement rendered is to be <br />considered as a general policy effecting like situations elsewhere. <br />1. R. Creadon & M. Shields, s/1 133-134.Broxbourne Road. <br />Request for variance (1123.12). Request variance to construct accessory building <br />(detached garage) prior to building house. Request 5 foot height variance and <br />1,570 square foot variance to construct detached garage. (Attached garage will be <br />constructed with dwelling). Request continued from meeting of October 7, 1992. <br />Chairman Gomersall called all interested parties before the Board. Mr. Creadon <br />and Ms. Shields, owners of the lot, Mra Taylor, builder, Ms. Monahan, previous <br />owner of the lot and neighbors, Mro and Mrso Koberna, C. Maniscaco, E. <br />Shimelonis, Mr. and Mrs. Plesz, Ms. Risko, Ms. DeChant, Mrs. Traczyk, and Mr. and <br />Mrs. Lieb a11 stepped forward. Chairman Gomersall asked that the record reflect <br />that Mre Koberna has asked to be excused from the first case. Mr. Creadon <br />requested that Mr. Koberna not be excused, since his abstention is the same as a <br />"no" vote. Law Director Gareau advised that since he asked to be excused, the <br />Board should vote an whether or not they want to excuse him. R. Gomersall moved <br />to excuse Mr. Koberna from the first case, R. Creadon and M. Shields, seconded by <br />B. Grace, and tmanimously approved. Mr. Koberna was excused. Ms. Shields read a <br />statement advising that they intend to build a ranch house with an out building <br />on the double lot. Larry Taylor is to be the builder and plans are leing drawn up <br />by H. Banker. At present they are clearing the land of grape vines, dead trees <br />and trees that are leaning toward existing or proposed structures. The lot will <br />remain wooded, there is to be no lawn, but additional trees and shrubs, will be <br />planted. Planning Commission has approved joining the two lots so there will be <br />181 foot frontage with 240 foot depth. She pointed out that map 233 shows the <br />relative size of their parcel in comparison to other lots on the street which <br />have 45, 50 or 60 foot frontages; the Metro Park is to the north; the lots to the <br />west are imdeveloped and there are no plans to extend utilities west an <br />Broxbourne Road; and the city owns the ptunping station property across the <br />street. She mentioned the characteristics of the property and explained that they <br />had located the buildings in order to save trees; to keep the buildings away from <br />the ditch which has flooded in the past; and to keep the buildings as close to <br />the front of the lot as possible because of the expense of digging through <br />sandstone. She further noted that the distance between the out building and the <br />neighbors house is greater than the width of the neighbor's lot; that the 30 by <br />60 foot out building will have a bathroom; will cost over $30,000.00 to <br />construct; will- be finished in the same exterior materials as the house; <br />materials; that the extra height was needed to accommodate a 12 foot garage door <br />which is needed for a recreational vehicle and the pitch of the roof will match
