NEW BUSINESS: <br />J. Kazak moved to excuse the absence of Mr. Schulz and Mr. Burk, seconded by <br />D. Spoerke, and unanimously approved. <br />Building Commissioner Conway advised that he and the Mayor have been <br />discussing legislation rEquiring registration for private home inspectors for <br />pre-sale inspections. If these inspectors are registered the Building <br />Department will have a record of what they are doing and if there are problems, <br />the license can be taken away. Mr. Conway would like the members to think about <br />how the licensing should be handled, if each applicant should be interviewed <br />prior to their being registered, or if the members prefer, the Building <br />Department could do a history eheck and the board could rely on the <br />Department's recoirmmendations. Mr. Conway advised that realtor-s have told him <br />that each office has 10 to 12 inspectors names available. Mr. Piar stated that <br />his company is setting standards for home inspectors across the country. Mr. <br />Ka,zak suggested that the board covld interview and relieve the Building <br />Department of another responsibility. Mr. Conway stated that if there is a <br />list, and real estate agents become aware that licensing is required there will <br />be some control. He is coricerned that council will want these inspections made, <br />and it is his belief that the eity cannot perform the function the same way a <br />private contractor can do it. His inspectors can only cite a clear cut code <br />violation, a private inspector can riegotiate between the owner and the buyer <br />regarding the price of correcting problems. The Building Department will charge <br />a registratian fee and afiling feem A building inspector would check up on a <br />new inspector about every other inspection at first, and then less frequently. <br />The inspectors will read the report when it is filed and if there is anything <br />that would concern the department, an inspection would be made. Realtors have <br />told him that at 70% to 80% of today's sales do have private inspections. He <br />clarified that it would cost $75.00 to register and probably $30.00 to $40.00 <br />per inspection. This would not even completely cover the cost of the <br />department's time. Mr. Piar believed that the city should do these i.nspeetions <br />and should inspect every transact2on as other communities do and stated that he <br />does this kind of work. Mr. Conway stated that the buyer relies on these <br />reports and are not total.ly awaxe of ahat the city has the power to violate, <br />and the owners believe everything is accegtable. Cities are not liable to any <br />individual home owners, an inspecti.on is supposed to benefit the city as a <br />whole and this has been established in court. So a home owner would have no <br />recourse if the city did the inspection, but if it is done privately, the home <br />owner could come back to a private inspeetor. Also each inspection should take <br />22 to 3 hours and his staff could not do this with their other work. An <br />2
