? <br />rear of the parcel and had.an easement through the Bob Evans drive. He would like <br />this rezoned to some compatible zoning classification to the zoning to the rear. <br />Mr. Dubelko advised that if this is zoned to Multi-Family, a referendum would be <br />required. Mr. Burskin stated that they can increase the square footage of parcel <br />"B" by moving the line back, and possibly could decrease the frontage in order to <br />give parcel "A" some Lorain Road frontage on Lorain. TZr. Dubelko stated that the <br />code allows the development of a General Retail parcel under the zoning <br />classification of the abutting parcel and if this property is subdivided a <br />restrictive covenant could be included restricting the development to miil.ti- <br />family purposes (if the abutting property is zoned Multi-Family). Mr. Dubelko, <br />agreed that to write such a covenant. Since this property is being used by United <br />Survey for storing their trucks and as a neeting place, Mr. Burskin questioned if <br />this U.se could continue imtil the property is sold. Mr. Conway advised that this <br />use could remain as a non-conform;ng use, but if the use chariges it would have to <br />conform to whatever is specifiecl. It svas clarified that the ownership could <br />change, but the use would have to remain the same. Again Mr. Burskin advised that <br />block "B" could be enlarged so that it would conforri to the code. Mr. Randell, a <br />representative of Forest City Auto Parts, vieiaed the plans and the proposal and <br />the restrictive covenant was explained to him. There had been some discussion of <br />splitting of the property abutting Forest City Auto Parts and Meinke Muffler and. <br />adding it to those properties. He was advised that if they bought a portion, they <br />could use it for parking, if it met code and if there was access to Lorain Road, <br />no access would be allowed onto a residential street. His company had no <br />immediate plans to acquire the property. Mr. Deichmarm stated that if a neia plat <br />was submitted showing the property line moved, the location of the exi.sting <br />building should be shown on the plat, to determine whether or not a non- <br />conforming setback was being created. Mr. Burskin stated that they are moving the <br />line away from the building. J. Thomas moved that C.E.I. is going to redraw the <br />plat to create a conforming lot in block "B" to maintain the 40,000 square foot <br />requirement. The Assistant Law Director is going to come up with a proposal for a <br />restrictive covenant that will follow the newly created parcel that will restrict <br />its General Retail.use exc?ept? J?obs a use that is compatible tJith the adjacent <br />rau.lti-fami.ly, seconded -:ny and tmanimously approved. Mr. Dubelko asked <br />for a copy of the lease that C.E.I. has with United Survey. <br />3) Gurt Dunlap Assembly and Subdivision Plat (Hastings Drive). <br />The proposal is to combine and re-subdivide Permanent Parcel Nos. 234-22-14, 27, <br />28, 35, and 234-22-32 into two (2) sublots. Location is the south side of <br />Hastings Drive abutting I-480 right-of-way at Stearns Road. Zoning is "B" <br />Residence, Sinble, entirely and both sublots conform to the Zoning Code <br />Requirements. <br />Mr. Dunlap presented the plat and explained that these lot back up to I-480 and <br />are the remnants of the former parcels. His house is on sublot 1 and fie will be <br />building on sublot 2. He has owned the rear portion of sublot 2 and just acquired <br />a lot on the front. The members had no problem with the proposal. B. Gorris moved <br />to accept the Curt Dunlap Assembly and Subdivision Plat, the proposal tQycombine <br />and resubdivide Permanent Parcel Nos. 234-22-14, 27, 28, 35, and 234-22-32 into <br />two (2) sublots. Location is the south side of Hastings Drive abutting I-480 <br />right of way at Stearns Road. Zoning is "B" Residence, Single, entirely and both <br />sublots conforr:l to the Zoning Code Requirements, seconded by L. Orlowski, and <br />unanimously approved. <br />V.
