??. <br />not demonstrated any basis for a zoning change except that it would be better to <br />down zone for economic reasons, and he had also stated tha.t a conforming house <br />could be built on the property. He presented the signed statements to the <br />Conmi.ssions. AZr. Moran, the owner of the adjacent property, advised that the <br />neighbors do not want the zoning changed and suggested that if the owner lowered <br />the price to something more reasonable, he could sell it. Councilwoman Bahas, who <br />is also a real estate agent, advised -that the homes on Dover Center sell very <br />well because the area has a residential flavor. She maintained that Brookpaxk <br />Extension was a natural barrier between the commercial area and the residential <br />area and that a two family hone wou•ld mar that separation. She asked that this <br />zoning not be changed. Other neighbors, Mrs. Jirka, Pirs. Lazlo, DZr. Piar, all <br />objected to the rezoning and nentioned-that the owner was not taking care of tne <br />property. Mr. Lynch, the real estate agent for this property, noted that most <br />people are against change, and gave a brief history of the property advising that <br />the owner paid more for the lot and the demolition of the house than the asking <br />price. He has attempted to buy some adjacent property to make this lot bigger, <br />but the adjacent owners were not interested. The actual depth of the property is <br />135 feet (the pTat shows 165 from the center of the street), in today's market <br />buyers are not bu.ilding on main streets. Most of the neighbors were interested in <br />consolidating _the back properties for some kind of a development, but their <br />aski.ng prices were not reasonable in today's -marke't. Only a very small house <br />would be economically feasible, wh-ich would not be beneficial to the neighbors, <br />nor would leaving the land vacant be beneficial to either the city or the <br />neighbors. Mr. Tallon disputed the the history of the property as Mr. Lynch had <br />explained it. He advised that, as.a couneilman for that waxd at that time, he met <br />with the dentist and advised him that this land would not be rezoned to build an <br />office, but he bought it regardless. - Nir. Orlowski stated that the house was <br />bought in 1988 for $40,000. It was clarified that the house was conder,med when he <br />bought the property. Mr. Orlowski pointed out that the developer's whole argument <br />was based on economics, and the Gommission's decision cannot be based on <br />economics. Councilwoman Bahas agreed that there might be a problem selling it, <br />but once the precedent has been set there, the courts would probably uphold any <br />subsequent requests. Mr. Lynch stated that despite his continued efforts there <br />has been no other interest in this lot and this is the lowest priced lot in North <br />Olmsted. Mr. Gorris mentioned severai homes that were built on Columbia Road when <br />it was a very busy street. N1r. Lynch maintained tha.t Coliunbia Road has more of a <br />rural character. It was clarified for the neighbors that a house could be built <br />on this lot, but because of the location it would not sell. Mr. Moran again <br />objected that it is not the neighbors' fault that the owner speculated on the <br />property, and the value of the homes in the neighborhood are at stake. They like <br />the neighborhood as it is. Mr. Lynr_h responded that all of the other neighbors, <br />except Mrs. Moran, showed interest in selling off back land for a development, if <br />the price had been right and maintained that it would be better to live baside a <br />$190,000.00, two family house than a$120,000 house. ?`?r. Orlowski stated that the <br />future _ use of back land is not part of this issue. Nir . Prosak, Mr. Lusardo' s <br />partner, asked that soma consideration be given to this proposal since this will <br />be aq ood two fanily house, side by side tmits, attached garages, three bedrooms, <br />and 12 or 2 full baths and would be compatible with this neighborhood, both <br />residentially and architecturally. He stated that these would be rented for <br />$800.00 to $850.00 per nonth so they would not be renting to low income or <br />transient type tenants. He noted that he is a real estate appraiser and he <br />studied the site at length, and decided that an up-scale two family dwelling <br />would be their only choice, and that only a base line mini,mnn standard single <br />family dwelling could be considered. Assistant Law Director Dubelko advised the <br />Commission that it would not be suffieient to deny a re-zoning because the <br />6
