Mr. Thomas advised the developer that in the approval of <br />this proposal he would like to establish a restriction on any additional accesses <br />to this parcel without a review by the Planning Colrnnission in order to make <br />certain that, should a larger developer move in behind this parcel and if it <br />would be decided to share access with this parcel which would create additional <br />accesses to that development, the Commission intencLs to retain .the right to <br />restrict an equal access anto the street, if it.were felt that this access would <br />have a nega,tive impact on the traffic pattern. Mr. Gorris stated that this was <br />brought up with the Wal-Mart proposal and should Wal--Mart or sonething else come <br />up on that parcel, such a shared access might be beneficial to all concerned, but <br />the Comunission wants the iight of veto. He further advised that they have <br />received a report from the Safety Department concurring with the Conunission's <br />request for a right turn only at both entrances. Mr. Skoulis questioned how a car <br />coming fran the south on Dover could go back north on Dover. The members agreed <br />it could not but stated that it would -be almost impossible to tum left out of <br />this parcel. In response to Mr. Thomas' question, City Engineer Deichmann advised <br />that if Dover Center was widened and an additional 14 or 15 feet was needed for <br />another lane, there would still be 5 or 6 feet of landscaping remaining, but this <br />would restrict the throat of the entrance which would make maneuvering more <br />difficult. He advised that this would not be likely in the next 5 or 6 years, <br />pointing out that it takes about 8 years to start construction after a consent <br />ordinance has been introduced; and the only discussion of widening was in <br />relation to the Wal-Mart proposal. It was pointed out that the request to the <br />Safety Department should have been for a right turn exit only, not for both <br />ingress and egress. Mr. Skoulis does not believe that a left turn entrance should <br />be allowed on Dover Center since it would back up traffic. Mr. Pozek stated that <br />the drive would be configured to allow a right turn only exiting, but this would <br />not be possible for the entrance. Building Coirunission Conway advised that the <br />lights are such that the south bound traffic is cleared out before the north <br />bound traffic can move. Mr. Thomas agreed that the left turn into the property <br />should not be restricted and suggested that a"Do Not Block Drive" sign might <br />help. The members agreed that the exit should be right turn only. Mr. Gorris <br />stated that he had requested both in the motion, but this could be sent back to <br />the Safety Department for their input. R. Tallon moved to approve the proposal <br />for Rally's Restaurant, 27208 Lorain Road,. to construct a drive-thru only food <br />service outlet, with the inclusions of the new color scheme, the right turn out <br />only, all recommendations of the Architectural Review Board, and with the <br />restriction an this parcel for any additional accesses without review and <br />approval of the Planning Commission with the right of the Planning Commission to <br />eliminate accesses on the street or accesses on the parcel if further accesses <br />seem to create a negative impact on the traffic pattern or the general area, <br />seconded by L. Orlowski. Roll call on motion: Tallon, Orlowski, 0'Rourke, <br />Skoulis, and Gorris, yesa Mr. Thomas, no. Motion carried. During the motion all <br />the members, except Mr. Thomas, agreed that the white neon strip could be <br />included, and it was clarified after the motion that this was the reason for Mr. <br />Thomas' negative vote. Chairman Gorris asked that the Safety Department be made <br />aware that, the Commissicrn was referring to right turn only exiting from the <br />property, but either righL- or left turn entering would be permitted and if they <br />have any strong feelings an that, .they should fo.rward that information to the <br />B.Z.D. Conmiittee. Mr. Pozek was advised that the B.Z.D. would be meeting on <br />February 17th and then this would go on to Council the first Tuesday in March. <br />IV.
