Square building and have added a sidewalk next to it to improve visibility. He <br />pointed out how the trucks would enter the site from Lorain Road and clarified <br />that some of the trees behind Olmsted Square could be saved. The area of the <br />future parking will be left as natural as possible and they will attempt to save <br />the trees in that area. In.response to questions, Mr. Gavin, attorney for Sherwin <br />Williams, advised that he aas present only to observe the proceedings, he could <br />.not answer any questions because Shercain Williams was not the developer. Mr. <br />Thomas asked about some statements that Mr.. Newberry made at previous meetings, <br />and paraphrased one...If we can't go any further, we will just pack up and go <br />away. Then later he referred to ..how far Wal-Mart will go with this before they <br />spend more time, money or Effort. Mr. Thomas believed that Mr. Newberry was <br />drawing a line, that they could not go further, and if they had other options, he <br />questioned whatc they were, considering the intensity of the residents' <br />opposition. He hoped that Wa1-Mart would be sensitive to connznity concerns and <br />values and noted that there has been a fear that North Olmsted is loosing control <br />of the commiinity. He asked how Mr. Bingham would respond to that and how Wal-Mart <br />would feel about that. Mr. Binghant responded that he would like to defer the <br />question to the record of the iniriutes that are at hand. In response to other <br />questions, Mr. Newberry stated that the mound would remain if the expansion were <br />constructed, and there would probabl:y be room for all the required spaces for the <br />expansion without encroaching•intd the mound (the pla.n showed that some of the 36 <br />spaces on the south appear to encroaeiz), but this could be addressed when the <br />plans for the expansion comes back for approval. Mr. Gorris reminded hun that he <br />had asked that any encroachment into the motuld be eli.minated from the plans, so <br />there Frould be no problems in the fiature when the expansion would be discussed, <br />arxi he would like to see the 'fixture expansion shown with no encroachments into <br />the mound. Mr. Newberry also advised that there had been some discussion with <br />Ral1y's regarding a cross easement, and;the plans show a preiiminary possibility, <br />however that may never happen sinee the discussion with Rally's has not been as <br />successful as it had been with McDonaTd's. Mr.. Orlowski asked if a new traffic <br />study had_:been done now that the construction had been completed on Porter Roacl. <br />Mr. Lepisto advised that it had, been taken on Friday from 4:00 p.m. to 6:00 p.m. <br />traffic increased from 11 to 33% witYi.75`,more cars added southbound and 240 cars <br />added northbound; on Saturday f-tom 12:00 to 2:00 p.m. there was an additional 51 <br />cars northbound and 151 cars southbound. Mr.o Lepisto will include these revised <br />figures in the traffic study. Regarding Nlr.. Tallon's suggestions at the last <br />meeting about the light poles, Mr. Newberry advised that the lighting plan shown <br />is tentative and he has advised Wal-Mar-t of the Commission'-s request that the <br />poles be lower. This cannot be completecl until the site plan is fi.nalized, but <br />Wal-Mart's normal lighting is a sharp cut-off fixture on a 30 foot pole. Mr. <br />Gorris advised that he had rECeived letters opposing this proposal from Mrs. B. <br />Kiumner, C. Ulewicz, R. & C. BuecYile.r and asked that these letters be incorporated <br />into the minutes (see attaehed). Many residents spoke at this time. Mrs. Joslyn <br />stated that this development will negatively impact on the quality of life in the <br />city and wondered about this since Wal-Mart's ads publicizes their interest in <br />quality of life. She is concc?rned about pedestrian and traffic safety and <br />believed that this traffic, especially during the holiday season, would ma.ke her <br />a prisoner on her own street. She stated tha.t Wal Mart is not wanted in this <br />area, and that the phrase "if you build it they will come" may not apply in this <br />case. Mrs. Herbster asked how oil and waste would be removed from the serviee <br />garage and how the noise from repairing cars would be handled. Mr. Newberry <br />responded.that the T.B.O. stands for tires, batteries, and oil change, all waste <br />oil will.be removed by a licensed disposer, and old tires and batteries will be <br />stored in outside 10 foot fenced in corrals with a roof prior to removal. In <br />response to questions about the traffic count, Mr. Lepisto explained that an <br />Friday, 178 vehicles headed southbound on Porter and turnecl left onto Mill Road,
