Mr. Deichmann responded that he has asked for drainage plans. She would also like <br />another traffic study done during the school year, and wondered how much traffic <br />would be created by stores which Usually follow a Wal-Mart. Mrs. Kuuner noted <br />that Westlake passed an ordinance prohibiting these large stores from locating <br />more than a ha.lf of a mile from a freeway: She does not believe that traffic <br />lights etc. will help the traffie. Mr. McFadden believed tha.t this cotmm,nity <br />needed to make a decision, if it sliould be residential or another Cleveland. The <br />City should have a traffic study-that looks out for the residents, not one that <br />is funded by developers. Mrs. Nar agreed with the other speakers, too iauch <br />traffic, poor location, etc. Mr. Sawchak questioned if a traffic study taken in <br />July woulel be representative of the aetual traffic since residents are on <br />vacation; and wondered if parking woulcl be adequate for Christmas shopping <br />season. Mr. Hoelter maintained that, when clearing the land, bulldozers had <br />destroyed the usefulness of tfie Cross Roads retentions system. Mr. Deichmam had <br />mentioned this previously. Mr. Richlick stated that an ambulance recently got to <br />his home in 3 minutes, but that might not be possible with Wal-Mart traffic. Mr. <br />Miller took exception to Wal-Mart's statement that they will be adding 10,000 <br />cars to the existing traffic, but wYll put in two lights and no one will ever <br />notice tYiem. He also requested an iniiependent traffic study taken during the <br />school year when children.and school buses are on the streets. In reference to <br />Mr. Piar's concerns about the adequacy of the sewer system to accommodate this <br />development, Mr. Deichmarni reiterated that they must have stonn water retention <br />and they must ineorporate the auto dealership's retention system into their own <br />since they are taking over that property., The regulations limit their out flow to <br />that of the undeveloped state. Also, he has requested that a grading and drainage <br />plan.be submitted prior to ariy approval being granted. Mr. Piar asked if there <br />Nvas any way the city could make Wa1=N'iart contribute to the infrastructure <br />improvements that will be neecled.' 'Mr. Dubelko responded that most impact fee <br />legislation is struck down by the courts, if the city can prove that this <br />development impacts the city in a unique way different fram other types of users <br />or businesses it might be approved. The Planning Commission caruiot address this, <br />it is outside the zoning ordinances. The city has looked at this before, but it <br />is a very difficult area of taxation. The city zoned these parcels and the city <br />has the primary responsibility for the infrastructure. Mr. Piar was also advised. <br />that the access points an Dover Center through other businesses have been-removed <br />fro?n this plan. He would like -the r.esicl.ents to have an opportunity to look over <br />the plans before the meeti.ngs.,• Mrs: Eyring was also concerned about traffic and <br />drainage. Mr. Moran asked if Wa1-Mart could be denied on the basis of traffic if <br />it would be so bad that emergency vehicles could not get through. Mr. Dubelko <br />again stated this was not a reason to deny them because the property is zoned for <br />this use, but if they build and nuisance conditions are created in that area, the <br />city could regulate or eliminate the nuisance by passing legislation for the <br />business regulation codes. He stated that you cannot prohibit a nuisance through <br />the zoning code. Mr. Dubelko inaintained that the traffic studies etce, could help <br />determine some of the on site problems, and often these problems are addressed <br />with help fran the developer.- Mr. Deichmarm advised him that the estimated cost <br />of these improvements range from l:`to 4 million dollars. Mr.. Trapp asked if <br />Rally's has a corporate relationsYiip or is a subsidiary of Wal-Mart. Mr. Bingham <br />indicated that it was not. Mr. Dubelko advised Mrs. Aiken that the Westlake <br />ordinance was being challenged in court.. He stated that he could not advise the <br />residents of how to go about addressing this problem and suggested that the <br />residents take theix concerns to' their counci]man who could help them. He agairi <br />reiterated what the Planning Commission could do to lessen the impact of a <br />development. Mr. Ulewicz complained that the traffic on Butternut Ridge is <br />horrendous now, and everyone will be using it as a cut through. Their office is <br />on Dover Center Road, he has a concern because that road frequently floods now in <br />7
