Mr. Gorris advised him thaL the Commission was advised <br />that the E.P.A. had passed upon the Sherwin Williams property. Mr: Deichmarm was <br />not aware of any documents presented to t-he city, the E.P.A. would have that <br />information. Mr. Gorris statEd that according to Mr. Sokol, there could be <br />problems off the site and that information has been sent to the E.P.A. Mr. Thomas <br />advised that the Commission was going to request additional information from the <br />E.R.A. ba.sed on Mr. Sokol's information. In response to the above coirIInents, Mr. <br />Newberry advised that he wouTd work with Engineering on the drainage plana <br />Regarding the envirorunental issues, he has seen the copies of the final closure <br />plan and other docunents relating to the closure of the Sherwin Williams landfill <br />or contamination that was supposeilly left after the building had been removed. <br />Mr. Sokol's revelations were news to him and probably to Sherwin Williams and <br />E.P.A. will follow up vn them. He was not aware of any damage done to the Cross <br />Roads detention svstem. Mr. Gorri.s called for a recess. After the meeting <br />reswned, Mr. Thomas stated that since there was no turther discussion trom the <br />commission, the members would like to do one of two things with the consent of <br />Mr. Newberry and Mr. Bingham, considering tYiat the revised plans were presented <br />at 8:00 p.m. this evening, the members would like to table this Until the meeting <br />in September and ask that speeifie items be elaborated on at that time; or the <br />commission could vote on thYS proposal as submitted tonight without the <br />infornation that will be requested. He noted that there are only 4 members <br />present and it takes 4 votes to approve ondisapprove a proposal. (Mr. Orlowski <br />ha.d left the meeting). Mro Bingham stated that without lmowing what information <br />was needed it would be hard to make a decision. He questioned if these were <br />matters that could be addressed subject to the information being reviewed by the <br />proper jurisdictional body at some point in the future. Mr. Thomas doubted that <br />the proposal would be approved this evening without this information since it <br />would be absolutely essential to have it before any determination could be rode. <br />Chairman Gorris clarified that if the commission does not act an a plan within 60 <br />days, it is assuned by Council tha.t it has been approved. Mr. Thoma.s outlined <br />some of the information needed: grade elevation and drainage; traffic counts <br />submitted which the commission would like correlated with past traffic impact <br />studies done in that location; a review of the changes submitted to the existing <br />approved plans of both McDonald's and Rally's regarding the access drives; the <br />commission would like to deterinine the validity of the waste deposit allegation <br />on the western site that was made this evening; a lighting plan should also be <br />submitted for review. Ttiese are only a few of the issues that the Commission <br />would need to complete their review. Mr. Gorris advised that they would be asked <br />to return to the September 28th meeting.. Mr. Bingham would prefer the next <br />available meeting after September-28th, or a special meeting in September. Since <br />some of the mmbers are missing and it would be difficult to set up a speeial <br />meeting, it was decided this wauld be heard on October 12th and the residents <br />Rere advised that there would be no further notice. Mr. Newberry agreed stating <br />that this would give them time to do some environmental work before returning. J. <br />Thomas moved to table the Wa1-Mart proposal Until October 12th with the following <br />requests. The submittal of a preliminary grading and drainage plan including the <br />retention basin for the Wal-Mart site which will include at least one alternate <br />plan to the proposed increase in the grade of the site and that alternate pl'an <br />should address the issue of a pump station for the storm water, and that <br />alternate plan should also set the buiiding no higher than the mean grade of the <br />right of way of Mill Road and Lorain Road, both plans will ha,ve a cross section <br />profile showing the anticipatcd height of the building and floor elevation in <br />relati.on to the right of wa.y liries and existing structures along all 4 sides of <br />the property including the mound.
