Zwick stated that they <br />intend to build three single faruly homes which are permitted under the Mixed Use <br />Zoning. It was clarified that the required frontage for an "A" residence district <br />is SO feet and a"B" residence is 70 feet.. 3ince these lots are about 400 feet <br />deep, the square footage should conform.. Mr. Gorris questioned if this is a <br />permitted use,and if so, should it follow tYie "A" or "B" residence restrictions. <br />Mr. Zwick maintained that the Mixed Use Godes includes "A","B", and "C" Residence <br />Districts, as well as others some of which r.i.ght relate to the church proposal. <br />tiir. Thorias was concerned about creatirg a non-conforming parcel out of a parcel <br />which could be split to accommodate two "A" Residential lots. He asstnned that <br />this was proposed for financial considerations: Mr. Zwick explained that the <br />ozaners looked at all the surrounding properties and because of the small, tmkempt <br />property adjacent to the south in 07msted Totanship, they believed that it wotald <br />not be to their best interest to build a la.rge, luxurious home on the lot. In <br />resgonse to Mre Thomas' questions, Mr. Zw:ick explained that the three houses <br />might be sir,iilar, since there is only about- a foot less at the building line of <br />the third lot. Mr. Thomas suggested two "A" lots with a fairly wide buffer area <br />on the south. Mr. Zwick pointed out that a cluster condominium could be <br />constructed there as we11. Mr. Skoulis noted that there could be two "B" lots and <br />one "C" lot, but Mr. Thomas noted that this lot was almost big enough to be a"B" <br />lot. Mr. Orlowski questioned the advisability of leaving the lots zoned for Mixed <br />Use, since 40 years from now there could be a significant change in the area and <br />land zoned Mixed Use could be used for a Ati.xed Use Proposal and could be a basis <br />for expanding that zoning in the arEa.. Mre Thomas clarified that any proposed use <br />would have to be compatible and must be approved by the city. Mr. Dubelko advised <br />that in iMixed Use, the proposal must be part of a development area, if this is <br />standing by itself it could not be developed as Mixed Use, it must be developed <br />in conjunction with the remaining Cinnamon Woods; and questioned if this was <br />shown on the preliminary land use plan as an area to be developed for a Single <br />Family Use. If this was part of the preliminary land use plan, it could provide <br />for this subdivision, if it makes sense fron a planning viewpoint. If not, it <br />could be split off into the three lots, and it could be rezoned, since he did not <br />think that the Board of Zoning Appeals would have a problem with granting it <br />since it is so close to the requirements. Mr. Grendell, attorney for Hennie <br />Homes, advised that originally this was shown as block "A" and it was represented <br />that they would return with single family for this portion. He does not know what <br />the plan showed, but the goal had been for single family hbmes. The owners <br />believed that beeause of the adjacEnt lot, a 150 foot wide lot would not be <br />feasible, because they would have to build a 20 foot high wall on the southo They <br />intend to build three homes that would be in keeping with the neigliborhood. Mr. <br />Gorris agreed that the 1.5 foot clifference is mi.nimal, however he is concerned <br />since there is an "A" zone to the north.of it. r1r. Grendell suggested tabling <br />this until the members have had a chance to look at the property. Mr. Thomas <br />suggested that he bring in photographs and by that time the original preliminary <br />lard use plan can be submitted. Mr. Grendell agreed to submit some preliminary <br />building plans at that time. Since the Commission will-be discussing Wal-Mart at the next meeting, October 12th, 14r. Grendell asked to be heard on the October <br />26th rieeting. Building Commissioner Conway will present the preliminary land use <br />plan. Mr. Grendell withdrew the proposal until the October 26th meeting. <br />Since Mr. Thomas is leaving the meeting, he asked about the status of Nightfall. <br />Mr. Conway advised that the Engineering Department has approved a drawing for <br />the parking lot and the owner is waiting for some cost estir,iates prior to <br />obtaining permits. The proposal is still within the 1 year time period after <br />Cor,?ission's review. <br />4
