unanimously approved. During the framing of the motion, rir. Pusti questioned how <br />the drawing showing the other drives would help since this is an existing <br />building, and they were not proposing to change the drives. Mr. Thomas explained <br />that this was usually requested of every drive thru restaurant and would help the <br />Commission with tneir future planning. He clarified that it would not be <br />necessary to identify these drives, just show the location. Vice Chairman <br />Orlowski stated that such a plan might identify that the driveway would be better <br />positioned somewhere else. The members discussed if this could return November <br />23rd since the Wal-P•lart proposal might come back at that time. Mr. Pusti would <br />prefer to be on that agenda but before Wal-Mart. This proposal will tentatively <br />be set for the November 23rd meeting, but the final decision will be up to <br />Chairman Gorris. <br />V. CONIMUNICATIONS: <br />Ord.93-140: This is an ordinance regulating superstores and limiting their <br />location. Assistant Law Director Dubelko advised that several groups worked on <br />this ordinance that was modeled on the Westlake ordinance, however several <br />changes were made to improve regulation. Mr. Skoulis objected to item rnunber 3, <br />under section B, because there was no land available on Great Northern Boulevard, <br />nor would there be land available on Lorain Road unless it was at the far west <br />end of the city. Mr. Dubelko stated that the ordinance was to lir.Lit the location <br />of these stores based on the the flow oi traffic, it was not drawn up for a <br />specific parcel. Item number (4) specified that such a store must be within <br />one-half mile of an Interstate highway interchange with both an eastbound and <br />westbound entrance and exit ramp. rlayor Boyle was present and explained that the <br />one half r,Lile distance was stated in the ordinance, however, this could be a <br />point of discussion, and even though Lorain Road is further away than one half <br />mile away it was included. Mr. Skoulis believed that the ordinances really <br />addressed a piece of land on Brookpark Park Road between the Westbury Apartments <br />and the condominiums. Vice Chairr,ian Orlowski asked what area a half mile would <br />include if concentric circles were drawn from the interchanges. Mr. Dubelko <br />stated that the half mile was taken directly from the Westlake ordinance, and the <br />?dea was to keep such a store close to an interchange as possible because of the <br />volume of traffic generated, a:nd it is possible that no parcels would be <br />available within that limitation. City Engineer Deichmann advised that it would <br />be slightly over a half mi.le to Lorain Road from the Stearns Road interchange, <br />but he also noted that the ordinance was not drafted just to deal with vacant <br />land, it merely deals with parcels, vacant or othenvise. Alayor Boyle clarified <br />that the ordinance was not written to be adopted as is, it has been written in <br />order to have the Commission and the Council discuss it. Mr. Dubelko advised that <br />North 0]risted's ordinance differed from Westlake's in that the definition of this <br />type store was more specific in order to eliminate confusion with other large <br />stores in the area. This ordinance is not to place a store in a specific space, <br />but to regulate where these stores can be located. Also sections (c) and (d) have <br />been included to put certain responsibilities on the developers. In reference to <br />the 100,000 square foot area needAd, Building Commissioner Conway advised that <br />Hill`s Department Store is 104,000 square feet and it is not a superstore, so the <br />more in depth definition indicating what was to be sold was needed to qualify a <br />store as a superstore. A1r. Skoulis is still concerned because, under these <br />definitions, the only area available that would qualify for a superstore is a <br />parcel on Brookpark which is zoned Mixed Use and it is his understanding that <br />there is aready a curb cut approved by O.D.O.T. for this parcel. He believed that <br />Wa1-Mart is looking at that parcel and he objects to item number 3. Mayor Boyle <br />4
