Mr. Gomersall pointed <br />out that this building would be an improvement over what is there now, but he is <br />concerned that the landbanked parking would be paved and then there would only be <br />10 feet of green area. Mr. Conway clarified that this could anly be paved if he <br />determined that more parking was required. Mr. Gareau noted that Baker's Square <br />and Red Lobster both had only a 7 foot landscape buffer and did a decent job. Mr. <br />Benik noted that the code was changed from 7 feet to 20 feet. He further stated <br />that he had no intention of pa.ving the landbanked spaces, and clarified that the <br />basement area would only be for storage. Mr. Orlowski had a concern about the <br />configuration of the drive which curves and suggested that the traffic would flow <br />better if there were 20 foot of landscaping in the front and the drive <br />straightened out. He believed that this landscaping would buffer the view of <br />Lorain Road for Mr. Benik's customers. He would concur with Mr. Deichmann and Mr. <br />Griffith if they believed the drive across the front is feasible, but noted that <br />this plan was not presented to the Planning Conunission. He questioned if it was <br />not aat of order to request a variancc on a plan that the Planning Commission has <br />not reviewed. He would still prefer the 20 foot landscape buffer. Mr. Gareau <br />stated that the developer had his own ideas of what would be pleasing to his- <br />customers, and wondered if it woulcl make a difference if there was 10 foot of <br />landscaping in ane place or the other. He mentioned Taco Bell which has a drive <br />with landscaping on either side of the drive. It was clarified that.this plan <br />must be returned to Planning Comni:ssion. Mr. Benik stated this is the plan he <br />prefers, however once he turns it over to an architect the building might be <br />moved. It was noted by the members tha.t if the drive were straight there would be <br />a better traffic flow, and Mr. Orlowski agreed. However, Mr. Koberna noted that <br />he would lose the aesthetics from his windows. Mr. Gareau stated that the ca.rs <br />would go faster if the drive were straight. The members reviewed the variances <br />requested. B. Gomersall moved to grant the request for two 7 foot variance for a <br />landscape buffer on side yards of the Ice Cream Parlor/Sandwich Shop, 27045 <br />Lorain Road, also a 5 foot variance for the rear yard landscape buffer, also a 10 <br />foot variarrce for front landscape buffer, also a 36 front setback variance for <br />the building and a variance to have both driveways having an entrance and exit in <br />accordance with Mr. Paul Deichmann's letter of August 4th within 100 feet of an <br />intersection, seconded by W. Purper, and Lmanimously approved. Variances granted. <br />9. Marv. Yasher, 28549 Hollv Drive. <br />Request for variance (1123.12). Request 40 square foot variance for area of shed <br />exceeding 2% of the rear yard. Also request 3 foot 3 inch variance from side <br />property line and 7 foot 10 inch varianee from rear property line. <br />Violations of Ord. 90-125, Sections 1135.02(d)(1) and 1135.02(d)(4). <br />Chairman Gomersall called all interested parties before the board. The oath was <br />administered to Mr. Yasher, the son of the applicant, and Mr. Roehrs, a neighbor <br />whose property abuts the shed. Mr. Yasher stated that the shed was about 2 feet <br />off the rear line and 2 feet off the side line. He clarified where the trees were <br />located (indicated on the site plan) and advised that the shed would have to be <br />placed about 15 feet from the rear line to avoid them. Mr. Roehrs had no <br />objection. W. Purper moved to grant the request to Mary Yasher, 28549 Holly <br />Drive, for a 40 square foot variance for area of shed exceeding 2% of the rear <br />yard and for a 3 foot 3 inch variance from the side property line and a 7 foot 10 <br />inch variance from rear property line, seconded by T. Koberna, and unanimously <br />approved. Variances granted. <br />6
