?? - v <br />stated that he had agreed to the 12 foot because that is what Planning CpmmiSS10ri <br />suggested, however he would still prefer 20 feet as originally mentioned by the <br />board. Mr. Grace stated that Planning ComnLission did not have to listen to this <br />for 3 meetings and have no new plan presented. Mr. Gomersall questioned if the <br />court meant this to be resubmittedwith the same proposal, the only difference <br />being that there are a few shrubs and the pole sign has been dropped. This is not <br />negotiating. The members agreed that a 12 foot buffer would be acceptable even <br />though they preferred 20 feet. Mra Gareau asked if there was any way that Halleen <br />would go along with the 12 foot. Mr. Giesser responded that they would not <br />because the 12 foot buffer eliminates a whole row of cars. In that event, Mr. <br />Gomersall stated that he would make a motion. R. Gomersall moved to grant the <br />request of Halleen Chevrolet, 27932 Lorain Road, the request for a variance to <br />display vehicles in 75 foot front setback, the request for a 13 foot variance for <br />front landscape buffer; and a 10 foot variance for a side yard landscape buffer. <br />Violation of Ord. 90-125, Section 1139.07, seconded by B. Grace. Roll call on <br />motion: Gomersall, Grace, Koberna, Maloney, and Purper, No. Motion failed to <br />pass. Variance denied. The neighbors then presented the plat that was approved <br />by Planning Commissian and explained that one lot was to remain as residential. <br />Mr. Conway explained that actually there are 2 residential lots, however there is <br />a court order on one that it can be used as commercial property. He advised that <br />this is not before this board, and P1arLn;ng Commission had asked the Law <br />Department to work on a restrictive covenant to make certain this lot would <br />remain residential. They asked how they are going to be advised that this was <br />done. Mr. Gareau stated that the Assistant Law Director attends P1arLriirig <br />Conmiission meetings, however if he asks to use this lot, it would again have to <br />go before Planning Commissian and they would be notified. <br />2. Dr. Yong Jung, 25566 Lorain Road. <br />Request for variance (1123.12). Request variances for location of temporary <br />leasing sign: 12 foot variance for encroachment of front property line, 10 foot <br />variance for encroachment of side property line, and variance for encroachment in <br />the prohibited 35 foot triangular area for the location of ground signs. <br />Violations of Ord. 90-125, Sections 1163.12 (G). <br />Chairman Gomersall called all interested parties before the board. The oath was <br />administered to Dr. Jung. Mr. Gomersall read the request and questioned how long <br />he would need the sign. Dr. Jung stated that he needed it until he got a tenant. <br />Mr. Gomersall suggested a 6 month time limit, but if he needed more time he could <br />return to the Board. Dr. Jung advised that he had one tenant and still had 1,600 <br />square feet to lease. W. Purper moved to grant variances to Dr. Yong Jung, 25566 <br />Lorain Road, for location of temporary leasing sign: 12 foot variance for <br />encroachment of front property line, 10 foot variance for encroachment of side <br />property line, and variance for encroachment in the prohibited 35 foot triangular <br />for the location of ground signs, with the stipulation that this is for a 6.month <br />period, seconded by J. Maloney, and unanimously approved. Variances granted. <br />3. Moen Corporation, 25300 Al Moen Drive. <br />Request for variance (1123.12). Request 80 foot setback variance to place <br />construction trailer on property. Violation of Ord. 90-125, Section 1141.06. <br />Chairman Gomersall advised that this request has been withdrawn. <br />4. Moen Corporation, 25300 A1 Moen Drive. <br />Request for variance (1123.00). Request 96 square foot variance for total sign <br />area and 9 foot height variance for "V" shaped temporary project sign. Violation <br />of Ord. 90-125, Sections 1163.12(f). <br />2
