Williamsburg Apartments/Waldo's Nurserv, 23460 Lorain Road.
Request for variance (1123.12). Request to have 17 less parking spaces than
required. (Additional spaces are being used for storage for nursery.) Violation
of Ord. 90-125, Section 1161.03.
Vice-Chairman Maloney called all interested parties before the board. The oath
was administered to Mrs. Pelech, owner of both buildings, and her attorney, Mre
Kostelnik< Mrs. Pelech explained that there was an area in the rear parking lot
that Waldo's have used for storage for over 30 years, and they would like to
continue using it. Building Commissioner Conway verified that this was the area
behind the fence, but there are also vehicles stored outside of the fence using
the apartments' parking spaces. Mrs. Pelech responded that the snow plow and
scoop are used to clear the parking lots. Mr. Maloney stated that the dumpster
occupies spaces 16 and 17 along with the truck and the scoop. Mr. Kostelnik-
stated that he has managed the apartments since they were built and there has
never been a problem before; there has been reciprocal pa.rking between the two
buildings. Mrs. Pelech advised that this problem occurred because a car,
belonging to the daughter of a resident, had been left there while she went on
vacation, was towed when they could not find an owner. Mr. Conway advised that at
the time the apartments were built, the code required 1-2 spaces per unit, 90
spaces were required for the 60 units and today's code would require more. He
questioned why, if there was to be reciprocal parking, the riursery parking was
posted that cars will be towed, but the apartment parking is not and nursery
customers do park in the apartment lot. Mrs. Pelech stated that they are going to
post apartment parking signs and ask the nursery customers to park in the rear.
Mr. Grace believed that if there is a towing zone on one side and there should be
a towing zone on the other. Mrs. Pelech noted that there was also parking
(nursery) on the east side. Mr. Conway stated this is frequently used for storage
of nursery materials. Mr. Kostelnik stated that there has never been a problem
with parking, and the residents signed a letter to that effect (in file). Mr.
Conway responded that the letter was signed by a majority of the residents, not
all of ther.i. The menbers decided to grant the variance for a year in order to see
if other problems occure Mr. Conway stated that if a variance is granted he wants
it to be granted to this owner only, since it is feasible that one of the
buildings might be sold separately. J. Maloney moved to grant for the
Williamsburg Apartments/ Waldo's Nursery, 23460 Lorain Road, the request to have
17 less parking spaces than required (additional spaces are being used for
storage for nursery) this variance is to be reviewed after a one year period of
time and subject to the current owner of the apartment and nursery and with the
stipulation that all identified spaces are to be left open and unobstructed.by
merchandise and vehicles other than the ttiao being eliminated for the mainteriance
equipment for the apartments, seconded by B. Grace, and unanimously approved.
Variance granted for a period of one year.
8. North Coast Foot and Ankle Specialist, 23823 Lorain Road.
Request for variance (1123.12).
