Violation of Ord. 90-125,
Section 1135.02(c)(2).
Chairman Gomersall ca.lled all interested parties before the board. It was noted
that the address should be 5859 Porter Road, not 5059 as stated on the agenda.
The oath was administered to Mr. Thomas who explained that he is replacing a
damaged garage which was in this same location. M. Gomersall moved to grant to
Mr. Gerald Thomas at 5859 Porter Road his request for a S foot rear setback
variance to construct detached garage to replace dama.ged garage, seconded by J.
A4aloney, and tmanimously approved. Request 4 foot height variance for fence on
portion of rear property and 2 foot height variance on portion of fence adjacent
to house. Violation of Ord. 90-125, Section 1135.02(f)(1).
Chairman Gomersall called all interested parties before the board. The oath was
administered to Ms. Boehmer who explained that she wanted a 10 foot fence across
the rear line which would be graduated down the side from 10 foot in the rear to
8 foot at the house. She explained that she needed the fence because of the noise
fron the stores behind her property and the fence on the side will enclose her
deck for privacy and noted that the ground slopes down in this area and a 6 foot
fence would not give her privacy. She stated that there was noise from delivery
and rubbish trucks as early as 6:00 .a.m. Building Commissioner Conway advised her
to file a complaint with the Building Department. After some discussion it was
decided that the side fence should be graduated down to 6 foot. R. Gomersall
moved to grant to Susan J. Boehmer, 27308 Mill Road, a 4 foot height variance for
fence across the rear property line and a variance from the rear property line to
the back of the house which should be graduated down from 10 foot at the rear
property line to 6 foot at.the house, seconded by J. Maloney, and unanimously
approved. Variance granted. Variance amended July 7, 1993.
5e McDonald's Restaurant, 27322 Lorain Road.
Request for variance (1123.12). The members had no problem
with the request. T.
