f? . : s^
i
Iiluminating Company of a restrictive deed that will be prepared and subr,ii.tted by
our Law Department (City of North Olmsted) to accompany the proposal. This
covenant should provide that C.E.I. and United Survey can continue with the
present use of the property, but in the event tha.t this property is transferred
in the future or if there is a desire of C.E.I. or United Survey to have any
other use, it can only be a multi-famzly use. Mr. Buerskin advised that Mre
Dubelko has not prepared the covenant as yet. He has a letter from United Survey
advising tahat they will agree to. United Survey is questioning what would happen
if they wanted to sell the entire busines.s, and this property would be used for
its current use. Mr. Conway advised that Nir... Dubelko was concerned that drafting
the covenant before the board granterl-the variance would be a waste of time, and
the variance could be granted subject to the covenant being worked out. The
members had no problem with this. R. Gomersall moved to grant the Cleveland
Electric Illumina, ting Company, 3900 Brendan Lane their request of a 50 foot
variance for width of parcel "A" £ronting on David Drive in order to split
property into tNao parcels, subject to a deed restriction agreeable by the city,
United Survey and the Illiuninating Company, seconded by T.. Koberna, and
unanimously approved. During the mot2on, Mr. Maloney suggested adding after
Parcel "A" fronting on David Drive, to clarify the parcel.
13. Glen M. Rvan, Jr. 3144 ClaRu.e Road.
Request for variance (1123.12). Request variance to have solid, 6 foot high
fence in side yard setback whieh is in the front setback of the adjacent
property. Violation of Ord. 90-125, Section 1135.02(f-2).
Chairman Gomersall called all interested parties before the Board. The oath was
administered to Mr.. Ryan, who explained that because they lived an a corner lot,
near a bus stop they had no privacy on their deck, and needed to add security
since there is an entrance beside the deck. He explained that the fence would be
board on board so that people cannot look into their windows. The mer, ibers are
concerned about the safety of a solid fence one foot. off the sidewalk. Building
Commissioner Conway advised that the fence should be in line with the front
setback of the adjacent house which should be 50 feet back. There is a hedge on
the abutting property so there would be no problem with 6 foot across the rear
line. The members discussed moving the fenee back 5 feet, but that would only
leave a path between the deck and the fence, and also there is a large oak that
was to be fenced in. It was clarified 'that the fence would also go to the house
beside the deck. It was suggested that he continue the request until next month
to revise his plans..Mr. Ryan suggested bringing the fence in and only installing
to the deck, and then installing a lattice on the decko Mrs. Ryan came forward
and agreed to this plan. It was agreed that the lattice should be as high as the
fence. J. Maloney moved to grant to. G1En M. Ryan, Jr. 3144 Clague Road, the
request to ha,ve a solid 6 foot high fence on the rear property line and to the
general side yard set back extending from the taestern corner to the eastern
corner of his deck and also permission to have lattice work extending to a
maximiun height of the fence along his deek on the north side to the east corner
and then south to the house, seconded by R. Gomersall, and unanimously approved.
Variance granted.
Chairman Gomersall and the members discussed the deposition that the members had
to take regarding the Halleen case. Mr. Koberna had not been called since he was
not on the board at the beginning of the case.
Buildi.ng Commissioner Conway presented the revised figures for the square footage
of the Michael's craft signs. It was stated that they need a 25 square foot
7
