. 1 <br />? <br />, <br />Chairman Gomersall called. <br />CITY OF NORTH OLMSTID <br />BOARD OF ZODTING APPEALS <br />MiNUTES-SEPTIIKBER..1, 1993 <br />the meeting to orcler at 7:30 p.m. <br />Present: B. Grace, T. Koberna, J. Nlaloney, W. Purper, and R. Gomersall. <br />Also present: Law Director Gareau,. Building Commissioner Conway and Clerk of <br />Commissions Oring. <br />W. Purper moved to approve the minutes of August 4, 1993 as written, seconded by <br />T. Koberna. Roll call an motion, Purper, Koberna, Ma.loney, and Gomersall, yes. <br />Mr. Grace abstained. Motion passed. <br />Chairman Gomersall advised those present that the board members had viewed the <br />premises involved in each case and that 3 affirmative votes are required for <br />approval. Each case would be judged an the physical situation peculiar to itself <br />so that in no way is a judgement rendered considered to be a general policy <br />judgement affecting properties or like situations elsewhere. <br />Clark Oil, 28925 Lorain Road. (REVISID) <br />Request for variance (1123.12). Request variance to have two prohibited signs on <br />canopy (7 square feet each). Also request 42.0 square foot variance for total <br />sign area allowed for a business use. Violations of Ord. 90-125, Sections <br />1163.12(j) and 1163.11(a). <br />Continuel fran meeting of August 4, 1993. <br />Chairman Gomersall called all interested parties before the board. No <br />representative was present. The request was voted on at the end of the meeting. <br />1. Carpet Barn M-ill Outlet, 23999 Lorain'Rd. <br />Request for variance (1123.12). Request vaxiance to change faces on existing <br />prohibited pole sign. Violation of Ord. 90-125, Sectian 1163.22(a). <br />Chairman.Gomersall called a11. interested parties before the board. The oath was <br />administered to Mr. Madeline, sign coritractor and J. Gerber, manager, who <br />explained that they were merely changing tlie faees in an existing pole sign and <br />if they installed a ground sign they would have to use a parking space. Mr. <br />MadEline was aware that the pole sign would ha.ve to-be removed by January 1, <br />1998. The members. voiced no objection. J. Maloney moved to grant to Carpet Barn <br />Mil-l Outlet, 23999 Lorain Road, the request for a variance to change the existing <br />faces an an existing prohibited pole sign, with the notation that this variance <br />will expire an Januar•y 1, 1998, seconded by B. Grace, and Unanimously approved. <br />Variance granted. <br />2. Scott Winkel, 24008 MaStick Road. <br />Request for variance (1123.12). Request variance to keep 6 foot fence on a <br />corner lot which is loeated within the required front setback of the abutting lot <br />on the side street. Violation of Ord. 90=125, Section 1135.02(f)(2). <br />,- Chairman Gomersall called all interested parties before the board. The oath was <br />administered to Mrs. Whitehead-Winkel who explained tYiat, as first time home <br />owners, did not realize tha.t they neecl.ed a permit. The members are concerned <br />about safety of pedestrians on the sidewalk since the fence is only about 9 <br />inches off a public sidewalk. Mrs. Whitehead-Winkel stated that they installed <br />the fence because there had been robberies on the street anel it was discovered <br />that a neighbor had comni.tted them.
