After <br />the fence was built an inspector, Mra Hootman, advised them that they needed a <br />permit and a variance and they fiiled out a1l the pa.pers and assinned everything <br />was a11 right. Almost a year later they were again contacted by another inspector <br />because of a neighbor's complaint and they were advised that the paper work they <br />submitted could not be found., Since that time there has been another robbery and <br />before they had a fence they clid have patio furniture stolena Mr. Gomersall <br />advised that he had received letters-from Mrs. Piwarski and from Bruce Thomas and <br />Yvonne Rolf-Thomas objecting to the fence. He noted that the fence was around <br />their back yard, not around the hause or garage. Ms. Whitehead-Winkel responded <br />that this fence does separate.them from.the- house wliere there have been problems. <br />Mr. Gomersall noted that the fence was right up to the sidewalk beside two <br />driveways and drivers could not see anyone on the sidewalk. Builcling Commissioner <br />Conway advised that in this case, since the abutting.house has a 50 foot front <br />setback;. the setback of their fence should be 50 feet back. Mr. Gomersall <br />realized they had a problem, but statEd that he could.not approve a fence right <br />up to the sidewalk. Mr.. Maloney agreed. Mr. Grace suggested that they moved the <br />fence back 10 feet and reduce the height. Mr. -Piwarski, whose wife wrote one of <br />the letters, and Mr. Bey, another neighbor, were sworn in at this time. They <br />explained the loeation of their homes to the Winkel home. Mr. Piwarski stated <br />that if the fence is to stay, he wauld -like it cut down at least 2 feet, and <br />stained or sealed for future appearance. Mr. Bey stated that it was his house <br />that was robbed and -he too would like to instali a 6 foot fence, -.however he <br />earmoto Mrs. Whitehead=Winkel clarified that a carpenter put up their fence, not <br />a fence contractor. Mr. Grace suggested-cutting the fence down 2 feet and moving <br />it back 10 feet. The neighbors-had no problem with that. Mrs. Whitehead-Winkel <br />agreed. Mr. Koberna believed that the carpEnter who erected the fence should <br />correct this at no charge. Building CoIIUnissioner Conway would like a 30 day time <br />limit stipulated. B. Grace moved to grant the variance.for Scott Winkel.and Vicki <br />Whitehead=Winkel, 24008 Mastic Road to keep a fence on a corner lot which is <br />located within a required front setback of an abutting lot on a side street with <br />the stipulatiori that the street side fence wili be movecl 10 feet off the sidewalk <br />and lowo-red to a 4 foot height on the sidewalk side only and this work is to be <br />completed within 30 days, seconded by J. Maloney, and unanimously approved. <br />Diaring the motion r1rs. Whitehead=Winkel stated that the fence will be stained or <br />treated. Variance granteda <br />3. Mircea Faur, 27390 Lusandra Gircle. <br />Request for variance (1123.12). Request 3 foot side yard variance for shed; also <br />request variance to have sYied in side yard. Violations of Ord. 90-125, Sections <br />1135.02(d)(4) and 1135.02(d)(1). Also requESt 6 foot rear setback variance for <br />decke Violation of Ord. 90-125, 5ection 1135.02(d)(4). <br />Chairman Gomersall called all interested .parties ,before the board. It was noted <br />that the address should be 27390, not 70. Building Commissianer Conway amended <br />the request to read to have a shed'in 'the side yard, not the rear yard as stated. <br />The oath was administered to Mr. Faur who explained that the back of the property <br />is uneven and hilly so he cannot put the shed in the backo Mr. Koberna noted that <br />the deck is encroaching on the CoE.I..easement and questioned if a variance could <br />be granted. Mr. Grace believed that it shouid be moved 6 to 8 feet away from the <br />property line. Law Director Gareau suggested that this is probably an overhead <br />easement. J. Maloney moved to grant tv Mircea Faur, 27390 Lusandra Circle, for a <br />3 foot side yard variance for a shed and als.o a.variance to have the shed in the <br />side yard. Also to grant a 6 foot rear set back variance for a deck, seconded by <br />W. Purper, and unanimously approved. Variance granted. <br />2
