<br />with this plan dated September 28, 1993 as a result of the Engineering <br />Department's recoirmiendations, seconded by R. Gomersall, and unanimously approved. <br />In reference to the Ha.lleen Chevrolet request that was denied and has <br />subsequently been appealed in court, Law Director Gareau advised that they have <br />come to an agreement regarding the Halleen truck lot. Mr. Giesser, attorney for <br />Halleen, and Mr. Gareau explained that the existing building will be torn down <br />and a new landscape buffer will start at the existing 7 foot strip on the <br />adjacent lot and will continue up at an angle to the required 20 foot landscape <br />setback. The white poles located in the landscape buffer of the existing lot will <br />be removed. The two lots will be assembled and there will be no driveway in the <br />new lot. The members agreed that this is a step in the right direction. Mr. <br />Gareau asked that the board reconsider these variances. Mr. Giesser advised that <br />where the white posts are being removed they will be putting in posts with a <br />chain to prevent cars fron being stolen. It was noted that the landscaping would <br />have to be approved by the Architectural Review Board. The members questioned if <br />there had to be notice. It was decided to amend the previous request for a <br />variance heard on February 3, 1993. B. Grace moved to let the record reflect that <br />Halleen Chevrolet, Inc. has mod.ified the request for a variance to display <br />vehicles in the 75 foot front setback and the 13 foot variance for a front <br />landscape buffer. Violations of Oxd. 90-125, Section 1139.07 (table). They are <br />now requesting a variance for the 20 foot setback consistent with the letter that <br />is being ma.de part of the record (see attached) that was handed to the Clerk. <br />That landscaped area will now go from 7 feet to 20 feet and will be green area <br />consistent with the recommendations of the .Architectural Review Board and the <br />Planning Commission, and that the variance with respect to display of merchandise <br />within the setback area will be amended so that merchandise can be displayed <br />behind this green area; and also that the 10 feet side yard variance will be <br />granted as previously requested, seconded by R.
