Violation of Ord. 90-125, Section 1135.08(a). <br />Chairman Gomersall called a11 interested parties before the board. The oath was <br />administered to Mr. McKenna, owner, and Mr. Schauer, contractor. The members had <br />all visited the site and had no objections. B. Grace moved to grant the request <br />of Ed McKenna, 23483 E1m Road, for a 5.5 foot average rear yard variance to <br />construct an addition, seconded by R. Gomersall, and tmanimously approved. <br />Variance granted. <br />15. Charles Pesta. 5364 Whitehaven Ave. <br />Request for variance (1123.12). Request 136 square foot variance for area of <br />detached garage which will exceed the permitted 20% coverage allowed for a rear <br />yard. Violation of Ord. 90-125, Section 1135.02(d)(2). <br />Chairman Gomersall called all interested parties before the board. The oath was <br />administered to Mr. Pesta who explained that he wanted a detached garage to <br />contain his 3 vehicles and a trailer. The existing attached garage will be used <br />for a fitness room with a hot tub. Mr. Grace moved to grant the request of <br />Charles Pesta, 5364 Whitehaven Avenue, for a 136 square foot variance for area of <br />detached garage which will exceed the permitted 20% coverage allowed for a rear <br />yard with the stipulation that the existing garage is not to be used as a garage <br />once the new one goes up, seconded by J. Maloney, and tmanimously approved. <br />Variance granted. <br />16. Wi:lliam and Amy Foltz, 6828 Warrington Dr. <br />Request for variance (1123.12). Request 15 foot variance for location of 6 foot <br />high fence which is required to be located at the setback line of the abutti.ng <br />property. Violation of Ord. 90-125, Section 1135.02(f)(2). <br />Chairman Gomersall called all interested parties before the board. The oath was <br />administered to Mr. and Mrs. Foltz, and neighbors, Mr. Martin, Ms. Williams, and <br />Ms. Klesh. Mr. Foltz explained that they intended- to install an in-ground pool <br />and the fence will run inside the existing 10 foot bushes an the adjacent <br />property line 10 feet behind the sidewalk and will hook up to the existing fence <br />which is at the end of the garage. Building Conunissioner Conway stated that only <br />the portian of the fence in setbaclc required a variance. Mr. Foltz explained that <br />he wanted a Cape Code style cedar fence which is a convex scalloped fence which <br />is solid. He further stated that it was not 6 foot high across the top of the <br />entire fence. Mr. Conway advised that with the newels on the top of the posts, he <br />would accept it as a 6 foot fence to enclose a pool. The shrubs will remain and <br />if they get too old they will replace them. It was clarified that the fence will <br />stop where the shrubs stop. Mrs. Williams did not believe that in-ground pools <br />were allowed by their home owners association. Mr. Conway stated that this is not <br />an issue with the city it is up to the.association. Mrs. Williams stated that she <br />did not like fences, and the beauty of Bretton Ridge was the openness and there <br />are more and more fortress type fences being installed. This is the first thing <br />drivers will see when they turn the carner. She is concerned that this will take <br />away fran the aesthetics of the area. Mr. Grace stated that there is nothing in <br />the city ordinances that prohibits a pool from being installed and if it is, a 6 <br />foot fence is required. Ms. Williams stated that her point was, if they are not <br />allowed to install apool, they would not need the 6 foot fence. It was noted <br />that the Klesh's do have a pool, but she believed that this was a fluke. Mrs. <br />Foltz stated that she would like the fence whether or not they have a pool. Mr. <br />Conway questioned if the fence could be seen with the hedges. Mrs. Williams <br />stated that these hedges lose their leaves in the fall so the fence will be seen <br />and she suggested that he install evergreens. Mr. Grace stated that this would <br />6
