rr% <br />J <br />J <br />? <br />CITY OF NORTH OLMSTID <br />BOARD OF ZONING APPEALS <br />MINUTES--NOVIIKBIIt 4, 1993 <br />Chairman Gomersall called the meeting to order at 7:30 p.m. <br />Present: B. Grace, T. Koberna, J. Maloney, W. Purper, and R. Gomersall. <br />Also Present: Law Director Gareau, Building Commissioner Conway, and Clerk of <br />Commissions Oring. , <br />B. Grace moved to approve the minutes of October 6, 1993, seconded by J. Maloney, <br />and unanimously approved. <br />Chairman Gomersall advised those present that the board members had viewed the <br />premises involved in each.case and that 3 affirmative votes are required for <br />approval. Each case would be judged on the physical situation peculiar to itself <br />so that in no way is a judgement rendered considered to be a general policy <br />judgement affecting properties or like situations elsewhereo <br />1. Patrick M. Moran. 5566 Burns Road. <br />Request for variance (1123.12). Request 3 foot side yard variance and 5 <br />foot rear yard variance to construct detached garage (existing shed will <br />be removed). <br />Violation of Ord. 90-125, Section 1135.02(c)(2). <br />Chairman Gomersall called all interested parties before the board. The oath was <br />administered to Mr. Moran. The members had no objections. W. Purper moved to <br />grant the request of Patrick M. Moran, 5566 Burns Road for a 3 foot side yard <br />variance and 5 foot rear yard variance to construct detached garage (existing <br />shed will be removed, seconded by J. Maloney, and unanimously approved. Variance <br />granted. <br />2. Chuck E. Cheese. 26108-22 Great Northern ShoApinR Center. <br />Request for variance (1123.12). Request variance to have 3rd building <br />sign on unit (one allowed). Also request 96 squa.re foot variance for <br />total sign area .allowed on a business imit. Violation of Ord. 90-125, <br />Sections 1163.12 and 1163.11-(c). <br />Chairman Gomersall called all interested pa.rties before the board. The "oath was <br />administered to Ms. Ziegler, sign contractor. Mr. Gomersall stated that some time <br />ago the members had thought that the sign for which they had granted a variance <br />would be facing Brookpark. Ms. Ziegler stated that she believed that they put it <br />on the south side because they wanted the exposure from the shopping center. <br />Building Commissioner Conway clarified that the board had approved the sign for <br />the north side, however later the contractor advised that there had been an error <br />and the sign had been needed for the south side. Mr. Conway reminded the members <br />that he had brought it back to the board after the mistake was discovered. Ms. <br />Ziegler noted that Tony Roma.'s next door had three wall signs because signs on <br />the other side could not be seen from Brookpark. She had not been involved in the <br />previous variance request. It was clarified that the new sign was 36 square feet <br />and they are 60 square feet over the allotted square footage at present. The <br />members believed that the manager or operator of the store should have been <br />present, and noted that he was not present at the first meeting either. Ms. <br />Ziegler explained that they are the local sign contractor and are working through <br />a na.tional sign contractor. After some discussion, it was agreed that this should <br />be tabled until the next meeting and require that the manager of the store be <br />1
