area. Mr. Helzer noted that there was a variance granted to rebuild a residence <br />in the industrial area recently. Mr. Conway stated that the house had been there <br />and was repaired and rebuilto Mr. Maloney stated that considering the health, <br />safety, and welfare of the children and he did not believe that this was the <br />right use considering the long range plans of the industrial area. Mr. Jent <br />advised that he is intending to builcl an industrial building on his lot. Since <br />an office was built too close to his lot line on the other side, he had to change <br />his plans and will now build closer to this side. Having a school there makes no <br />sense to h.i_m and the proposed playground would be next to his building. J. <br />Maloney moved to grant Rainbow's End Nursery School, 31266 Bradley Road, a <br />variance to conduct a riursery school in the Limited Industry/Industrial Park <br />District, seconded by R. Gomersall. Roll call on motion: Maloney, Gomersall, <br />Grace, Koberna, and Purper, no. Variance denied. <br />11. Bob Grace, 30406 Lorain Road. <br />Request for variance (1123.12). Request 650 square foot variance to <br />construct a residential attached garage in a General Retail District. <br />Violation of Ord. 90-125, Section 1135.02(c)(3). <br />Mr. Grace stepped down from the board. Chairman Gomersall administered the oath. <br />Mr. Grace had presented a final drawing of the garage. Build.ing Commissioner <br />Conway had submitted a letter stipulating that this garage is based on <br />residential standards and would probably not be approved for a commercial <br />building. Mr. Grace stated that he has had his trucks and trailer vandalized and <br />would like to get them inside and he will agree to the stipulations in Mr. <br />Cornway's letter. Mr. Conway clarified that even though the property is zoned for <br />General Retail, this building is being used as residential and only-a 750 square <br />foot garage is permittede He mainly wants Mr. Grace to understand that, if the <br />board grants a variance tmder the residential code, that would not guarantee him <br />a commercial use, he would have to go through all the approvals required before <br />this could become a commercial building. Mr. Grace agreed. B. Gomersall moved to <br />grant Bob Grace, 30406 Lorain Road, the request for a 650 square foot variance to <br />construct residential attached garage in a General Retail District, seconded by <br />T. Koberna. Roll call on motion: Gomersall, Koberna, Maloney, and Purper, yes. <br />24r. Grace abstained. Variance granted. <br />Mr. Gomersall advised that Mr. Thomas of the Planning Commission had asked the <br />members to look at the final, accurate plans presented by the Ice Cream Parlor. <br />Mr. Conway explained that he believed that Mr. Thomas thought that, had the board <br />seen this plan originally, they would not have granted the variance. The members <br />studied the plan and agreed that the Engineer's comments that had determined that <br />this egress was satisfactory had a greater influence on their decision. They did <br />not believe that the volume of business from an ice cream store would cause that <br />many problems, certainly not as many as a McDonald's would. <br />Regarding the changeable copy signs for gas prices, the members agreed that, <br />especially since gas stations have to post gas prices, these signs do not have to <br />be brought before the board for a variance. <br />Mr. Conway will not be present for the December lst meeting. He wili include his <br />comments in the packets and will be in the office to answer any questions. <br />Mr. Purper will not be at the next meeting. <br />Mr. Gomersall advised that on Monday, November 8th, there will be a meeting of <br />the Legislative Comnittee of Council to discuss search lights and council is <br />asking for the board's opinion. Mr. Gomersall will attend, and asked the members <br />for their input. Mr. Conway explained that, when the previous code was in effect, <br />it had been his determination that search lights should require a variance but <br />5
