? . <br />CITY OF NORTH OLMSTED <br />BOARD OF ZONING APPEALS <br />MINUTES-MAY 6, 1993 <br />Chairman Gomersall.oalled the meeting to order at 7:35 p.m. <br />Present: T. Koberna, Ja.Ma,loney, W. Purper, and R. Gomersall. <br />Absent: B. Grace. <br />Also Present: Law Director Gareau, Building Commissioner Conway, and Clerk of <br />Commissions Oring. <br />W. Purper moved to accept the minutes of Apri1 14, 1993, seconded by T. Koberna, <br />and unanimously approved. <br />Chairman Gomersall advised those present that it takes 3 affirmative votes to <br />approve a request.and tha.t each case would be judged on the.physical situation <br />peculiar to itself so that in no way is a judgement rendered considered to be a <br />general policy judgement affecting properties or like situations elsewhere. <br />1, Thomas Stennner, 29930 Lorain Road. <br />Request for variance (1123.12). Request 1794 square foot variance to construct <br />an additional garage. Violation of Ord. 90-125, Section 1135.02(c)(3)e <br />Chairman Gomersall called all interested parties before the.board. The oath was <br />administered to Mr. Stemmere Mr. Gomersall explained.tha.t there is an amendrient <br />to the request because the garage will need a 5 foot height variance. Mr. Stemmer <br />explained that he needed the garage to house a motor home and a boat. The <br />property is deep and is zoned General Retail 500 feet from Lorain Road back. <br />Building Cominissioner Conway stated that since this:is retail property, he is <br />concerned that this building might be used commercially and it would not conform <br />to the codes since it would have to be 50 feet off the rear property line. He <br />also pointed out that the proposed location is partially residential and <br />partially retail. Mr. Stemmer agreed to locate the garage 50 feet from the rear <br />property line. J. Maloney moved to grant the request of Mr. Thomas Stemmer, 29930 <br />Lorain Road for a 1794 square foot variance to construct an additional garage and <br />also a 5 foot height variance with the condition that it must be 50 feet from the <br />rear property line, seconded by R. Gomersall and unanimously approved. Variances <br />granted. <br />2. Mr. and Mrs. Phil Bryeski, 27190 Pompton Dr. <br />Request for variance (1123.12). Request 12 foot rear yard variance for average <br />rear setback to construct family room addition. Violation of Ord. 90-125, Section <br />1135.08. <br />Cha.irman Gomersall called a.l'1 interested parties before the board. The oath was <br />administered to Nir. Bryeskie Chairman Gomersall advised that his neighbors, Mr. <br />and Mrs. Bovard, had notified the board that they did not object to the request. <br />The members had no questions. W. Purper moved to grant the request to Mr. and <br />Mrs. Bryeski, 27190 Pompton Drive for a 12 foot rear yard variance for average <br />rear setback to construct family room addition, seconded by T. Koberna, and <br />unanimously approved. Variance granted. <br />3. National City Bank (formerly Northeast Appliance), 4608 Great Northern Blvd. <br />Request for variance (1123.12). Request variance to have 47 less parking spaces <br />than required. Request 13 foot setback variance for kiosk for ATM. Violation of <br />Ord. 90-125, Sections 1161.06(w) and 1139.07.
