<br />refer the Wal-Mart proposal, located on Brookpark Road to the Board of Zoning <br />Appeals and since he believed that a variance should indicate a hardship, and he <br />did not believed that there was a hardship indicated for the east setback, a ane <br />hundred foot setback can be pLOVided with the commitment of this Planning <br />Commission to take care of the parking requirements and to landbank that parking. <br />However, the variance on the BLOOkpark Road side would bring it up with the <br />Colebrook Condominitams and would not be negatine issue, and would maintain some <br />continuity along the street and would not be a problem as long as the buffering <br />in the area of the Colebrook Condominiums can be maintained and it would not <br />affect the buffering along Brookpark Road. The Commission believed that the <br />second variance which would be a 72.37 foot variance on the northern boundary <br />line and would recommend that the Board of Zoning Appeals provide that variance <br />and as part of the motion the Commission would recommend that the Board of Zoning <br />Appeals not grant the variance on the east setback, seconded by B. Gorris. Roll <br />call an mtion: Thomas, Gorris, Alston, Miller, 0'Rourke, and Tallon, yes. Mr. <br />Orlowski, no. Motion carried. After the motion was made, Mr. Gorris questioned if <br />mounding could be put within the Brookpark right of way. Mr. Conway stated that <br />trees were installed on the Sun ToV./Office Maxx development in the right of way. <br />Mr. Deichmann advised that O.D.O.T. would ha,ve the right to sa.y no. Mr. Dubelko <br />stated that this would be a State issue, but generally he did advise the City <br />against putting anything in the right of way if it involves transportation needs. <br />Mr. Miller was still concerned that the Safety drive on the east side of building <br />would not be paved and believed that the Commission owes it to the city and the <br />adjacent residents to ask the developers at least to put in a stone base so the <br />city does not loose a fire truck. Mr. Thomas explained that this is what would be <br />required, an unpaved road would satisfy all the requirements of the Safety <br />Department to a11ow a vehicle the size of a fire engine or other safety vehicles <br />to go behind the building.
