the fence. Mrs. 0'Rourke believed that the residents might prefer to see the <br />trees. Mr. Neiaberry agreed that they could be on the residents side. Mr. Gorris <br />asked how much width would be needed to have the entire mound 8 feet high. Mr. <br />Newberry stated that they would need about 14 to 15 feet more width. He clarified <br />that the corner of the building as shown xvas 50 feet off the property line and <br />the truck dock is 36 by 25 feet. Mr. Conway clarified that the distance between <br />the building and the boundary was 50 feet at the closest point. Mr. Newberry <br />stated that they are trying to eliminate any possibility of other facilities <br />behind the building. He explained that the Mixed Use district required a 25 foot <br />green area in a 100 foot setback from any boundary to a building line, and they <br />are asking to encroach into that 100 feet in order to eliminate developing any of <br />that 75 foot area. The unpaved emergency road would be next to the trash <br />compactor. Mr. Miller asked how usable this type road would be. Mr. Newberry <br />stated that the code stipulated that it would have to be 25 feet wide and there <br />is room for it. NIr. Gorris explained that this has been done in other areas and <br />the Fire Department did not requirec. paving. Mr. Newberry clarified that the <br />trash compactor was not part of the building. rlr. Tallon stated that the majority <br />of the building needed a 22 to 25 foot variance, and suggested that they move it <br />up to the line and move the trash compactor to the other side of the T.B.O. Mr. <br />Newberry stated that the compactor needs to be in the warehouse area. Mr. Tallon <br />stated that after compactors are a year old the pistons start to squeal and are <br />noisy. Mr. Newberry stated that the noise was not uncomfortable and they do <br />maintain their equipment. Mr. Thomas asked if there N'Tere reasons, other than <br />parking requirements, to ask for a variance. He estir.qated that about 60 parking <br />spaces would probably have be eliminated to conform but if they moved the <br />building, the Commission could permit them to landscape the entire 100 feet and <br />landbank all those spaces in back. Mr. Newberry is not sure 4dal-Mart would agree. <br />Mr. Thomas asked that they provide an overlay showing the building set back at <br />the required 100 feet in order to verify exactly how many spaces would have to be <br />landbanked. It was clarified that the code requires 832 spaces and they are <br />providing 858, so the potential would be there to eliminate fewer than 60 spaces. <br />Nir. Thomas and r1r. Tallon agreed that this could be done with little adjustment. <br />Mr. Pliller is concerned that the noise from the trash compactor would bounce off <br />the mound. Mr. Newberry stated that it might, but there would be vegetation on <br />the riound also and the noise would not be extremely loud. NIr. Tallon disagreed. <br />Mr. Newberry stated that it was unlikely that the compactor would be used in the <br />early morning hours. Mr. Thomas asked if ldal-Mart might be willing to limit the <br />hours that they would use the compactor. Mr. Bingham would not commit to specific <br />hourso Mr. Newberry stated that t:here is a.noise ordinance to regulate that. In <br />reference to the grade, N1r. Newberry clarified that the finished floor elevation <br />would be about 1 foot above the average existing grade underneath the building, <br />there would be no drainage restrictions in this area. Mr. Thorias asked what the <br />proposed infrastructure work would cost the city. Mr. Deichmann responded that <br />there is none planned at present. In response the Mr. Tallon's questions, Mr. <br />Newberry advise that sidewalks were planned along Brookpark Road with a walk that <br />goes north and south to the building along with crosswalks. None are planned on <br />Country Club Boulevard because there is nothing to connect them to. Mr. Tallon <br />noted that these walks were in the sidewalk legislation that is forthcomi.ng. He <br />also asked if there was a possibility of enclosing the trash compactor repeating <br />that they can become noisy. Mr. Newberry stated that they intended to screen and <br />buffer it, not put it in a ha.rd enclosure since a structure mi.ght reflect the <br />sound over the top of the mound, and he would prefer to absorb the noise.
