Conway advised that the drive was one foot <br />wider than necessary, and Mr. Dixon noted that sidewalks are usually 1 foot off <br />the property line, so if he made the driveway 1 foot narrower, there would be 4 <br />feet from the curb to the sidewalk. The members believed that this would be <br />better. The representative of Wendy's advised that delivery trucks came in from <br />Sparky Lane and exit on to Lorain Road. Mr. Deichmann advised that it would be <br />difficult for a garbage truck to exit through the 9 foot wide drive; however it <br />was noted that this was an imaginary line. It was established that the adjacent <br />property was owned separately from Wendy's. The members agreed that this proposal <br />could be referred to both to the Board of Zoning Appeals and the Architectural <br />Review Board, and in the meantime, they would request that the developer seek <br />input of the Traffic Engineer of the city as well as the Building Commissioner on <br />the sharing of the driveway with the adjacent parcel. J. Thomas moved to refer <br />Wendy's Restaurant, 26650 Lorain Road to the Board of Zoning Appeals with the <br />recommendation that they grant a variance for the following: a 3 foot setback <br />variance for the front signage which would be 7 foot from the right of way; a <br />variance for the landscape set back, in the front it would be a 13 foot variarice <br />and on the eastern side it would be a 17 foot variance and in the rear it would <br />be an 8 foot variance. Also the Connnission would make a recomendation to the <br />B.Z.A. that they grant a variance for an additional wall sign. Aside from the <br />recommendations to the BeZ.A., the Commission refers this to the Architectural <br />Review Board for their input on landscaping, as well as a review af the alternate <br />muted colors that the Commission requested of the developer. Also the developer, <br />has agreed to eliminate the Wendy's girl logo on the sign and therefore lower the <br />height of the sign by 1 foot, 9 inches that was taken up by the Wendy's girl logo <br />and re-submit a new sign design for that. Also the Commission would like the <br />developer to provide information as to whether or not there is a legal easement <br />for use of the adjacent property .Eor its traffic flow for entering and exiting on <br />Lorain. Also ask that the developer to work with the adjacent property owner not <br />only to maintain the existing single Lorai.n Road access and entrance, but to <br />redesign that driveway to make more sense both for the safety of pedestrians <br />crossing it, as well as traffic entering and exiting, iri particular the <br />Commission would like the developer to pay attention to the traffic that exits <br />Wendy's and crosses over the entrance lane of Metro 25. We would like the <br />developer to devise some sort of design, curbing, or additional width, some way <br />to make that drive less hazardous, and to eliminate that cross over, or at least <br />to lessen its impact. Zde would also like the developer to run that by the <br />Engineering Department or Larry Griffith, the traffic engineer for his input <br />before comirg back to the Conunission, and ioe would also like to Mr. Griffith to <br />give us his opinion of that dual use of that driveway and far any future dual use <br />driveways, the criteria we need to provide a safe entrance and exit for these <br />parcels. Also to refer this to the Safety Department for their input, seconded by <br />B. Gorris. Roll call on motion: Thomas, Gorris, Alston, Orlowski, 0'Rourke, and <br />Tallon, yes. Mr. Miller, no.
