Mr. Burk had a problem with that since <br />he had an experience with an older family member wandering out in the middle of the night and <br />drowning in a creek. Mr. Bower advised him that a two rail, 30 inch, white fence will be installed <br />along the roadway and there would be a double row of barberry and quince hedge surrounding <br />the lakes, which he believed would be superior to a fence. They install it as a continuous hedge <br />which will be maintained at about 3 feet high. 1VIr. Engoglia would like the fence higher since the <br />sides of the lake on the first fairway are very steep and he is concerned about a child slipping in. <br />He thought a 4 foot fence with 3 boards would be better along the roadway and also along the <br />one that has a steep embaukment. He further suggested that they might be able to make the sloop <br />more graduaL He realized that this could not be done on the creek. Mr. Conway clarified that the <br />hedges and fence would be installed along the roadway as depicted, but on the golf course side, <br />the lake will be graded to a more gradual sloop, and the pond within the Vista Homes area can <br />have bushes three feet high around the perimeter. The fourth lake in Vista Homes the landscaping <br />that is to the rear is satisfactory as long as it provides a continuous barrier. Mr. Conway <br />established that, if they need a points of access for maintenance, gates should be provided. Mr. <br />Stone, a resident, had no objection to the lakes, but he is concemed about the lake behind the <br />number 2 hole, because there is a very steep embavkment on the 1480 side and he is concerned <br />that children might climb up on the embankment and slide down. He noted that before there was a <br />flat area where people could walk between 480 and the pond, but now the embank?nent goes right <br />down to the pond. Mr. Bower noted that there is a fence on top of the grade for 1480, but what <br />they could do is to extend the landscaping hedge. Mr. Burk suggested extending the landscaping <br />around to the 1480 side. After some discussion, it was decided that they would install a hedges <br />along the lake between the lake and the fence on the 1480 side where there is a deep drop and, in _ <br />addition to what is shown. P. Engoglia moved to accept the proposal as Mr. Bower revised it, <br />seconded by D. Spoerke, and unanimously approved. <br />V. NEW BUSINESS: <br />Simmons Construction Co., 36792 West Law Road, Grafton, Ohio <br />Hearing to determine if certification of registration should be revoked u.nder Section 1317.09 of <br />the Building Cade. <br />Building Commissioner Conway advised that currently there are five violations of the code.: 1) <br />the B vent trough the roof is touclung the roof sheathing, a 1 inch clearance is required; 2) the <br />attic access is undersized; 3) the anchor bolts were not installed in the foundation; 4) the stairwell <br />heights for the first and second floor stairs, as well as the basement stairs, are insufficient; and 5) <br />there is insufficient ventilation in the attic spaces. Further the inspectors have noted that there are <br />areas of poor workmanship throughout the structure. Mr. Duffy, attorney for Mr. Simmons, Mr. <br />Fox, owner of the home, and Mr. Kettle, building inspector were sworn in at this time. City Law <br />Director M. Gareau stated that it should be known that currently there is a case in litigation and <br />this hearing is not to litigate that case,.:It was brought to the attention of the board by the Building <br />Commissioner that there are some outstand.ing violations of the code, and it has also been stated <br />that, although there has been an offer to correct them, permission had not been granted to do so. <br />First, this board must determine if there are Bu.ilding Code violations, and Mr. Kettle is present to <br />2
