, <br />?- ... . . <br />CITY OF NORTH OLMSTED <br />BOARD OF ZONING APPEALS <br />MINiJTES-DECEMBER 14, 1994 <br />Chairman Gomersall called the meeting to order at 7:30 p.m. <br />Present: M. Boyle, T. Koberna, J. Maloney, W. Purper, and R. Gomersall. <br />Also Present: Law Director Gareau, Building Commissioner Conway, and Clerk of <br />Commissions Oring. <br />J. Maloney moved to approve the minutes of November 2, 1994, seconded by T. Koberna, and <br />unanimously approved. <br />Chairman Gomersall advised all present that each of the board members had viewed the premises <br />involved in each case, and that three affumative votes would be required for approval. Each case <br />would be judged on the phys'ical situation peculiar to itsel? so that in no way is a judgment rendered <br />considered to be a general policy judgment affecting properties and like situation elsewhere. <br />l. Best Buv, 5140 Great Northern Plaza South Request for variance (1123.12). Request variance to have search light for grand opening. Violation <br />of Ord. 90-125, Section 1163.04(g). Continued from meeting of November 2, 1994. <br />Chairinau Gomersall called all interested parties before the board. There was no representative <br />present and • since no one had been present at the last meeting, Chairman Gomersall moved to grant <br />the request for a variance for Best Buy, 5140 Great Northern Plaza South to have a search light for <br />grand opening. Violation of Ord. 90-125, Section 1163.04(g). The motion was seconded by J. <br />Maloney, and unauimously approved. Variance denied. <br />2. LaSalle Fumiture, 25757 Lorain Road Request for variance (1123.12). Request variance for 3 foot, 6 inches of excess height of canopy <br />sign. (Please note: awning with sign is installed). Violation of Ord. 90-125, Section 1163.12(d). <br />Chaunnan Gomersall called all interested parties before the board. The oath was admiuistered to <br />Mr. J. Sharp, contractor. Mr. Gomersall noted that the awning had been installed and the sign was <br />on it. Mr. Sharp stated that he had not done much business in North Olmsted and was not registered <br />because he was told to wait until the variance was granted. He explained that he installed the awniug <br />before the variance was granted because the customer had asked him to have it installed for the <br />opening. He clarified that the wording on the awniug would remain as it since the Architectural <br />Board did not permit them to add the words `Turnishings and contemporary furuishings". Building <br />Commissioner Conway advised that he did apply for a sign permit and was told that he would have <br />to get approval from both the Architectural Review Board and this board for a variance. After the <br />A.R.B. refused to permit the excessive verbiage, the, sign was installed prior to receiving a variance. <br />The members discussed the variance. Mr. Conway advised that they could replace a portion of the <br />awniug as long as it did not exceed 50% of the replacement without getting another variance, <br />however in January of 1998 all non-conforming signs must be addressed by the board. J. Maloney <br />moved to grant the request for LaSalle Furniture, 25757 Lorain Road for a variance for 3 foot, 6 <br />iuches of excess height on a canopy sign. Violation.of Ord. 90-125, Section 1163.12(d). Also note <br />that they will have to resubmit to this board on January l, 1998 if the canopy remains in effect. The <br />motion was seconded by T. Koberna. Maloney, Koberna, and Purper, yes. Boyle_and Gomersall, No. <br />Motion carried. Variance granted.
